City Hall (1:29:44) Council President Busby said the prayer. Council Member Johnson led the pledge. Roll Call of Council Members: Attending: Council Member Flora, Council Member Johnson, Council Member Chambers, Council Member Erickson, Council President Busby, and Mayor Merrill Council Member Walker did not attend the meeting. Committees: MEPI, Cultural Arts, Grants, School Board, MUSIC, MYAB, Traffic & Safety, Emergency Services Board, Trails, Beautification, Parks, Recreation, Urban Renewal, Airport, Golf Board, and Legacy Flight Museum Council Member Flora asked Mayor Merrill for an update regarding the status of the Rick’s building encumbrance. Mayor Merrill reported he contacted Kathryn Hitch with Senator Mike Crapo’s office and was informed that an inquiry regarding the building encumbrance has been submitted. A meeting with a federal government representative to discuss the encumbrance has been scheduled. Council Member Erickson expressed his gratitude for the invitation the Councilmembers received to attend the Christmas Concert at BYU-Idaho University. B. Other Reports: Staff Reports: (1:52:18) A. Finance: – Scott Miller 1. Financial Reports Finance Controller Miller reviewed the Treasurer’s Expenditure Report by Fund. He noted the report includes the encumbrances in the balances. He said they are working with a Tyler Munis Technology representative to generate a Treasurer’s Expenditure Report without the encumbrances. 2 B. Public Works: - Keith Davidson (2:18:09) 1. Resolution No 2023 – 15 Set Hearing Date for Local Improvement District 52 (LID 52) Final Assessment Roll for January 17, 2024 Public Works Director Davidson reported the State Board of Public Transportation approved the grant list for the two-million-dollar grant. The grant funds will be awarded to the city in January. The city is going to be able to complete a lot more street projects in 2024 because of the grant funds. He also reported the street crew will be picking up Christmas Trees for the first two weeks in January. Public Works Director Davidson recommended setting a Public Hearing date for Local Improvement District 52 (LID 52). Review Adopt-A-Storm Drain Program Public Works Director Davidson reviewed the Adopt a Storm Drain Volunteer Opportunity. City Attorney Zollinger has already volunteered to adopt a storm drain near his house. 3 3. Resolution No 2023 – 16 Idaho Transportation Department Grant Agreement under the Idaho Airport Aid Program, FS Program #L24SRXE Public Works Director Davidson reviewed the Grant Agreement with the Idaho Transportation Department under the Idaho Airport aid Program FS Program No. L24SRXE. These grant funds will be used to relocate the airport. He has met with the Federal Aviation Administration (FAA) representative and the city’s consultant Ardura regarding the scope of the work needed to complete the environmental assessment. The city will submit for a grant with the FAA for the environmental assessment costs. They will also be looking for land acquisition to trade with the Bureau of land Management (BLM). Resolution for a Grant Agreement with Idaho Transportation Department Under the Idaho Airport Aid Program FS Program No. L24SRXE Resolution No 2023 - 16 Exact from the minutes of a regular meeting of the City Council of City of Rexburg held on December 20, 2023. Mayor Jerry Merrill, introduced the following Resolution, was read in full, considered, and adopted: Resolution Number 2023 - 16 of City of Rexburg, Idaho accepting the Grant Offer of the State of Idaho through the Idaho Transportation Department, Division of Aeronautics, in the maximum amount of $4,000,000.00 to be used under the Idaho Airport Aid Program, FS Program number: L24SRXE, Project number: SP-01 in the development of the Rexburg-Madison County Airport; and Be it resolved by the Mayor and City Council of City of Rexburg, Idaho (herein referred to as the City as follows: Sec. 1. That the City shall accept the Grant Offer of the State of Idaho in the amount of $4,000,000.00, for the purpose of obtaining State Aid under FS Program Number: L24SRXE, Project Number: SP-01 in the development of the Rexburg-Madison County Airport; and Sec. 2. That the Mayor of the City of Rexburg City Council is hereby authorized and directed to sign the statement of Acceptance of said Grant Offer (entitled Acceptance) on behalf of the City, the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City on the aforesaid statement of Acceptance; and Sec. 3. A true copy of the Grant Agreement referred to herein be attached hereto and made a part thereof. Resolution No 2023 – 17 Cooperative Agreement with Idaho Transportation Department to repair and replace the sewer lines at the intersections between University Blvd and US-20 (Exit 332), also between SH33/Main St and US-20 (Exit 333) during the State’s construction on these interchanges; Key No 21798/21799 Public Works Director Davidson reviewed Resolution No 2023 -17. When ITD constructs the divergent diamonds highway interchanges this summer. There are items the city is paying for such as landscaping, textured concrete, repairs on a storm drain line and installing a section of a pressure line. The city is paying 5% of those costs. Mayor Merrill mentioned the city had budgeted for these repairs. Resolution for a Project Development Agreement with Idaho Transportation Department for the Repair and Replacement of Sewer Lines at the Intersections of US-20 & Exit 333 and US-20 & Exit 332 Project Nos. A021(798) and A021(799) Resolution No 2023 - 17 WHEREAS, the Idaho Transportation Department, hereafter called the STATE, has submitted an Agreement stating obligations of the STATE and the CITY OF REXBURG, hereafter called the CITY, for installation of City sewer line by the State during construction of the State’s project; and WHEREAS, the STATE is responsible for obtaining compliance with laws, standards and procedural policies in the development, construction and maintenance of improvements made to the Federal-aid Highway System when there is federal participation in the costs; and WHEREAS, the CITY is fully responsible for its share of project costs; and NOW, THEREFORE, BE IT RESOLVED: 1. That the Agreement for Federal Aid Highway Project A021(798) and A021(799) is hereby approved. 2. That the Mayor and the City Clerk are hereby authorized to execute the Agreement on behalf of the CITY. 3. That duly certified copies of the Resolution shall be furnished to the Idaho Transportation Department. There is a tree that needs to be trimmed by the strip mall near Taco Time. Council President Busby expressed his concerns with the streetlight not being aligned with the road on University Blvd and 12th West. Public Works Director Davidson said the streetlight should be aligned and as development occurs that section of road will be widened into a four-lane road. Mayor’s Report/Business: (2:25:10) Mayor Merrill reported the first City Council Meeting on Wednesday, January 3rd, will be held at the Romance Theater. The reason the meeting is being held at the Romance Theater is to hold the inauguration of the newly elected Councilmembers. Items for Consideration: (2:27:36) A. Planning and Zoning recommendation to approve an amendment to the Rexburg Development Code, Ordinance No. 1200, as it pertains to Permitted Uses in All Zones #23- 00622. Designated as Ordinance No 1306 if motion passes – Alan Parkinson Planning and Zoning Administrator Parkinson explained there were work meetings held where discussion took place regarding these amendments to the Rexburg Development Code pertaining to uses in all zones. Council Member Flora said the consolidation will make the code easier to understand. Planning and Zoning Administrator Parkinson said the chart is not part of the decision it is only the uses in all zones. Council Member Johnson asked about the changes regarding short-term rentals. Planning and Zoning Administrator Parkinson explained in the classification for short-term rentals there were boarding houses, bed and breakfast and short-term rentals. In the amendments these uses were combined into one called short-term rental. Council Member Erickson moved to suspend the rules for Ordinance No 1306 and Amendment to the Rexburg Development Code, Ordinance No. 1200, as it pertains to Permitted Uses in All Zones; Council Member Flora seconded the motion; Mayor Merrill asked for a roll call vote: Those voting aye Those voting nay Council Member Flora none Council Member Johnson Council Member Chambers Council Member Erickson Council President Busby The motion carried.
