HomeMy WebLinkAboutRes. 04.24 Wine License RESOLUTION No. 2004-24 A RESOLUTION OF THE CITY COUNCIL OF REXBURG, IDAHO, REAFFIRMING THAT WINE AND BEER LICENSES ARE ADMINISTERED UNDER CITY ORDINANCES NO. 341, 535 AND ORDINANCE NO. 636. WINE COOLERS AND OTHER WINE BEVERAGES THAT HAVE BEEN TRADITIONALLY SOLD UNDER BEER LICENSES WILL CONTINUE TO BE SOLD UNDER A WINE LICENSE AS WAS ESTABLISHED BY THE CITY COUNCIL ON DECEMBER 11, 2001. WHEREAS , Wine coolers and other wine beverages have been traditionally been sold under Beer Licenses; and WHEREAS, The City Council recognizes that the State of Idaho requires every Community to offer Wine Licenses to separate those sales from beer sales; and WHEREAS, Wine Licenses have been sold in the City of Rexburg since December 11, 2001 by Resolution; and WHEREAS , Ordinance No. 535 establishes that "No beer shall be sold, offered for sale, or given away, or be permitted to be consumed upon any licensed premises or where beer is sold or dispensed to be consumed on the premises, whether conducted for pleasure of profit, on and during the following days and hours: Sunday, Memorial Day, Thanksgiving and Christmas from 1:00 a.m. to 10:00 a.m. the following day. On any other day between the hours of 1:00 a.m. and 10:00 a.m."; and WHEREAS , The State of Idaho prohibits the sale of alcoholic beverages on election day; and WHEREAS , Ordinance No. 636 establishes the fees for licenses to sell retail beer in containers for off premises consumption at $50.00 per calendar year, and draught (tap) beer consumption on premises at $200.00 per calendar year; and WHEREAS , The State of Idaho and Madison County have changed the annual expiration date for Retail Alcohol Beverage Licenses to September 30 each year; and NOW THEREFORE BE IT RESOLVED that the City Council of the City of Rexburg approves the addition of Wine Licenses in addition to the traditional Beer Licenses for beer and wine retail sales in the City of Rexburg; and BE IT FURTHER RESOLVED , that the annual expiration of said Wine and Beer Licenses will expire on the same date of September 30, each year to coincide with the State of Idaho and Madison County’s expiration dates; and BE IT FURTHER RESOLVED , that Wine Licenses and Beer Licenses will be regulated under the same City Ordinances.
