NOTICE OF PUBLIC HEARING
TO AMEND THE DEVELOPMENT CODE FOR THE CITY OF REXBURG
Public Hearing: January 4, 2024, at 6:30 pm to be held before the Rexburg Planning and Zoning
Commission at 35 N 1st E, Rexburg, Madison County, Idaho (#23 00811) to amend the current
DEVELOPMENT CODE (Ordinance 1200) for the City of Rexburg.
It is proposed to amend the current DEVELOPMENT CODE concerning substantive and
non-substantive items. All proposed modifications to the DEVELOPMENT CODE may be
reviewed at the offices of Planning and Zoning or the City Clerkâs office. The proposed
substantive changes amending Development Code Ordinance No.1200 (by section) are
delineated below:

Amend Chapter 2 Accessory Dwelling Definitions
Repeal 3.02.150 Rental Requirements in Zoning Standards for All Zones
Adopt 4.00.025 Rental Requirements in All Residential Zones
Amend 3.02.060 Standards Accessory Structures for All Zones
Repeal 7.00.030 Accessory Building in All Industrial Zones
Amend 3.02.130 Addressing Standards in All Zones
Amend 3.02.080 Exception to Setback Requirements in All Zones
Amend 3.02.090 Screening and Landscaping Requirements in All Zones
Amend 3.02.160 Sidewalk Requirements in All Zones
Amend 3.04.060 Parking Area Screening and Safety Requirements in All Zones
Amend Chapter 4 Residential Zone Standards
Amend Chapter 5 Combined Use Zone Standards
Repeal 10.03.050 Plat Time Limitation
Amend 10.03.080 Filing a Plat with County Recorder
Amend 3.04.070 Parking Surface Requirements in All Zones

At such hearing the Planning and Zoning Commission will hear all persons and all objections and
recommendations relative to such proposed permits. The City Clerk will also accept written
comments at City Hall or email clerk@rexburg.org prior to 4:00 p.m. on January 3, 2024. This
notice is given pursuant to the provisions of Section 67-6508, 67-6509 and 67-6511 Idaho Code, and
all amendments thereof.
