AMENDMENTS TO HISTORICAL PRESERVATION COMMITTEE BYLAWS
AN ORDINANCE AMENDING THE CITY OF REXBURG’S HISTORICAL PRESERVATION COMMITTEE BYLAWS ORDINANCE NO. 884 CONCERNING SUBSTANTIVE AND NON-SUBSTANTIVE ITEMS; THE FOLLOWING CHANGES HAVE BEEN
MADE: AMENDMENTS TO SECTION III(1) COMMISSION CREATED APPOINTMET TERMS ADJUSTING NUMBER OF REQUIRED BOARD MEMBERS; SECTION III(2) AMENDING MEMBERS OF THE COMMISSION’S QUALIFICATIONS;
AND PROVIDING FOR THE EFFECTIVE DATE OF THE ORDINANCE.
WHEREAS, The City of Rexburg is incorporated as an entity of the State of Idaho; and
WHEREAS, Chapter 46 of Title 67 of the Idaho Code empowers cities to make provisions for the identification and preservation of historic sites; and
NOW THEREFORE, be it ordained by the Council of the City of Rexburg, in the State of Idaho, that the Historic Preservation Bylaws be amended as follows:
SECTION 1: AMEND COMMISSION CREATED APPOINTMENT TERMS:
The Historic Preservation Commission shall consist of at least five (5) members but no more than nine (9) who shall be appointed by the Mayor with the advice and consent of the Council.
All members of the commission, shall be residents of the City and shall demonstrate an interest in the historical and architectural development of the City, with at least one (1) member
who meets the Secretary of the Interior’s Professional Qualifications Standards and shall be appointed with due regard to the proper representation of such fields as history, architectural
history, architecture, landscape architecture, urban planning, engineering, archeology, real estate, and law. Members of the commission cannot be employed by the City, but an employee
of the City will be appointed as a liaison to the commission by the Mayor with the advice and consent of the council. Members serving on the commission are tasked with formulating new
ideas, information gathering, receiving public testimony and comments, analyzing complex issues, and making recommendations on specific projects. The members involved in the decision-making
process serve as representatives for their entire community.
SECTION 14: SEVERABILITY CLAUSE The provisions of this Ordinance shall be deemed severable and a finding by a court of law that a provision of the Ordinance is unlawful shall have no
effect on the remaining provisions.
SECTION 15: EFFECTIVE DATE The City of Rexburg, Idaho City Council shall enact this Ordinance amending Ordinance 884 otherwise known as the Historic Preservation Commission Bylaws of
the City of Rexburg, Idaho upon its passage, approval and publication; and shall be in full force and effect from January 3, 2024, and after the required approval and publication according
to law.
