Planning and Zoning Minutes - October 19, 2023

Chairperson Smith opened the meeting at 6:30 PM.
Planning & Zoning Meeting:

4. Reappointment of Commissioners - Reappointment of Commissioner Chairperson
Smith, Commissioner Kempton, Commissioner Richards, and Commissioner Lawrence –
Mayor Merrill – Pushed to next meeting because of Mayor Merrill’s absence.
5. Work Meeting
a. (23-00622) Permitted Uses – Development Code Amendment – Discuss and
review the proposed Permitted Uses Updates.
Alan introduced the proposed permitted uses explaining there were inconsistencies and
redundancy in the uses, and some uses had unknown definitions. He explained the legend and
the format of the spreadsheet, indicating that the permitted uses spreadsheet started with
approximately 750 lines, and now it is down to about 250 lines. He stated that the proposed
uses don’t take away any rights, it just makes it easier for citizens to find uses, and that both
the Strategic Team and Legal had reviewed the proposed updates.
Vince asked what the uses would look like in the new plan. Alan explained it will be a section
within Standards for All Zones, labeled Permitted Uses, and will be in a chart format. He
explained that there will be a Residential chart, a Commercial Uses chart, and an Other Zones
chart, and that this format is standard for other cities.

Randall inquired about the file in the packet labeled “Clean”. Alan explained it was an example
of what the charts would look like if the uses were adopted as proposed. The group agreed that
the “Clean” file was much easier to read. Eric asked why the red lined version was being
presented. Alan responded to show the proposed changes and give City Council and Planning &
Zoning all of the information, the uses staying the same, being added, removed, and combined.
Sally asked about Accessory Animals. Mr. Southwick commented that the number of animals is
no longer included in the code. Alan thanked him and said it would be looked into.

Bryanna asked about new legislation allowing Accessory Dwelling Unit’s (ADU’s) in all zones.
Alan explained that staff is writing code for ADU’s now, and once adopted, it will show as
permitted in the residential zones. The group discussed ADU’s, their potential effect on the
shortage of affordable housing, and possible regulations the city can place on them. Sally
inquired about Short-term Rentals. Alan confirmed that staff is also working on a Short-term
Rentals code update. The group discussed potential regulations and safeguards to protect
neighborhoods.
Vince asked if the permitted uses were considered a living document, and the process to
update them. Alan explained that the uses can be changed at any time and would require a
public hearing before Planning & Zoning and approval from City Council.
Sally and Tisha inquired about Single-family Dwelling, attached (except townhomes) and if they
would be allowed in LDR3 in addition to LDR2. Alan explained that yes, it is allowed, and that
staff had recognized this error the previous day. The group briefly discussed Manufactured
Housing Communities.

Sally asked if Antiques, listed under the shopping category, needed the word Store added
behind it. Alan asked the group if it should be added, and the group discussed antiques, where
they could be sold, and the possible outside storage of items.
Aaron asked if these uses were outside of the Form Based Code. Alan confirmed.
The group discussed Agriculture and Farm & Construction Equipment and the use being
proposed as a Conditional Use Permit (CUP) to ensure it fits the area and will not cause any
problems.
Vince inquired about the zone of the Veterinarian on 2nd E. Alan confirmed it is CBC and
discussed the impacts of small and large animal veterinarians as well as kennels, and indicated
there is another use category further down for veterinary practices.

Mr. Southwick asked where the section in the code that shows accessory uses, such as gardens
and fruit trees, was listed and if it, as well as pets, would be listed in the uses chart. Alan
answered that those accessory uses are in either the Standards for All Zones or the Standards
for All Residential Zones, and that pets would not be listed in the chart. Kyle asked Alan if
allowing pets was a type of land use. Alan responded it was not. Mr. Southwick recommended
that a reference to pets and accessory uses be placed within the chart.
Bryanna inquired about home occupations and preschools. Alan explained when a CUP would
be needed and the differences between a preschool, nursery school, and daycare.
The group briefly talked about campgrounds before moving on to Short-term Rentals and
today’s terminology.
Vince pointed the conversation to the potential of apartments above offices. Reference was
made to Mixed Use zones instead of CBC zones, grandfathered uses, Form Based Code,
Conditional Use Permits, and adding residential restrictions to CBC that would make it the same
as Mixed Use.
Definitions of uses in the Group Living category were examined and Alan explained the two that
are regulated by state statute.

In the Recreation and Entertainment category, Alan touched on athletic fields, and Eric brought
up ice skating rinks, recommending they be allowed in residential zones so children could walk
to the rink. Bryanna questioned how the parking would be handled in a neighborhood. Eric
specified it would be handled like a park. Aaron brought up the new YMCA in Meridian and
Colin used Coeur d’Alene as an example. Alan touched on residential amenities as well as
commercial uses filling up the Light Industrial zones, and not leaving the trades a place to go.
After a lengthy discussion regarding Recreation Centers in residential zones, Alan polled the
group and found 10 in favor of allowing Recreation Centers in residential zones, including TAG,
RR1, and RR2, with a Conditional Use Permit.
*Staff to change Recreation Centers from R-CON to AD-CON to allow them in all residential
zones, including TAG, RR1, and RR2, with a CUP.

The group circled back to preschools, daycares, and home occupations. It was agreed that “Pre”
should be added to the K-12 in the Schools category.

The group quickly touched on additional School uses, as well as uses in the Assembly-Deceased
and Transportation categories.

In the Animals category, Eric inquired about Animal Grooming being allowed as a home
business and Robert reasoned that Kennels may want to have a grooming component to their
business. Jim agreed that a kennel in TAG should be able to apply for a CUP to also allow
grooming. It was decided to allow Grooming in TAG with a Conditional Use Permit.

The group quickly reviewed the Food & Drink, Office Type Business, Medical & Emergency, and
Government categories.
Jim suggested adding “Asphalt” to the Concrete Mix Plant in the Building & Construction
Category and the group agreed.

The conversation briefly explored Storage, Shopping, Antiques, Pawn Shops, Service Stations,
Lock Smiths, and Hardware Stores.
While discussing the Minor Assembly & Other Innocuous Manufacturing category, Randall
informed the group that there is a pottery kiln on campus and suggested it be added as a
permitted use in the University District zone.
*Staff to add Pottery as a permitted use in UD.
Alan talked through the Heavy Manufacturing and Utilities categories. Randall asked for the
difference in Public Facilities and Utilities. Aaron suggested adding “Utilities” to Public Facilities
to clarify.

Alan indicated that once the changes are made, the document will be sent out to the group to
be reviewed again. He encouraged the group to reach out with any questions.
