ORDINANCE NO. 469
AN ORDINANCE TO REGULATE ELECTRICAL WIRING AND EQUIPMENT
INSTALLED WITHIN THE CORPORATE LIMITS OF THE CITY OF REXBURG,
IDAHO, EXCEPT WIRING AND EQUIPMENT WHICH IS USED FOR THE
GENERATION, CONTROL, DISTRIBUTION OR COMMUNICATION OF PUBLIC
UTILITIES, AND TO BE KNOWN AS THE CITY OF REXBURG, IDAHO,
ELECTRICAL CODE, PROVIDING CERTAIN EXEMPTIONS FROM THE
REQUIREMENTS OF SAID CODE AND FURTHER PROVIDING FOR MINIMUM
SAFETY STANDARDS, SPECIAL REQUIREMENTS, ALTERATIONS TO CITY
WIRING, ELECTRICAL INSPECTOR, JURISDICTION OF ELECTRICAL
INSPECTOR, AUTHORITY TO DISCONNECT, PERMITS AND FEES FOR
PERMITS, REQUIRING A STATE LICENSE AND PROVIDING FOR CERTAIN
EXEMPTIONS: ALSO PROVIDING THAT THE CITY SHALL NOT BE HELD AS
ASSUMING LIABILITY BY REASON OF THE INSPECTION REQUIRED:
PROVIDING FOR THE PENALTY FOR VIOLATIONS THEREOF: REPEALING
ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND
PROVIDING WHEN THE ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF REXBURG, IDAHO:
Section 1. SCOPE OF CODE.
The regulations of this code shall apply to all electrical wiring and equipment installed within the corporate limits of the City
of Rexburg, except wiring and equipment which is used for the generation, control, distribution or communication system of a
public utility and which is installed by or for, and owned and maintained by an electric or communication utility operating
under due authority granted by the City. Electrical wiring in Federal Buildings, Railway cars or automotive equipment is
exempt from the requirements of this code.
Section 2. MINIMUM SAFETY STANDARDS.
Except as herein provided all installations of wires and equipment to convey electric current and apparatus to be operated by
such current, made after the effective date of this code, shall be in substantial accord with the 1965 Edition of the National
Electrical Code, as approved by the American Standards Association, relating to such work so far as the same covers both fire
and personal injury hazards, and as the National Electrical Code shall be amended, revised, compiled and published from time
to time and as such amendments or revisions are adopted by the Council of the City of Rexburg. Three (3) copies of the
National Electrical Code as adopted shall be kept on file in the office of the City Clerk for use and examination of the public.
Section 3. SPECIAL REQUIREMENTS.
All buildings, of any kind, located within the Fire District and all public buildings, commercial buildings, industrial buildings
and apartment buildings with more than 4 dwelling units, located anywhere within the corporate limits of the City of Rexburg
shall be wired to conform to any of the following designated article of the National Electrical Code:
Article 346, Rigid Metal Conduit: Article 348, Electrical Metallic Tubing; Article 350, Flexible Metal Conduit; Article 352,
Surface Metal Raceway; Article 362, Wireways; Article 364 Busways; Article 354, Underfloor Raceways; Article 356,
Cellular Metal Floor Raceways; Article 358 Cellular Concrete Floor Raceways; Article 330, Mineral Insulated Cable; Article
331 Aluminum Sheath Cable; Article 347, Rigid Non-Metallic Conduit may be used only where installed underground,
embedded in concrete, or in indoor locations where subject to severe corrosive influences.
Section 4. ALTERATIONS TO EXISTING WIRING.
When extensions and/or alterations are made to any electrical circuit in or on any building or structure, coming under the
provisions of this code, which said circuit was not originally installed in a manner complying with the provisions of this code
and/or the ordinances of the City of Rexburg, said electric circuit, in its entirety, shall be made to conform to such provisions
of this code as are particularly applicable thereto.
Section 5. ELECTRICAL INSPECTOR.
The Mayor is hereby authorized and directed to enter into an agreement with the Idaho State Electrical Board, Department of
Law Enforcement, to furnish electrical inspection service to the City of Rexburg, as authorized by Sec 54-1001C of the Idaho
Code. Electrical inspections made under such an agreement shall be made in accordance with this code by a duly appointed
City Electrical Inspector acting as Electrical Inspector for the City of Rexburg.
Section 6. JURISDICTION OF ELECTRICAL INSPECTOR.
Except as herein provided the installation of electrical wiring or equipment in or on any building or structure within the
corporate limits of the City of Rexburg, shall be done at all times subject to inspection by the electrical inspector of the City
of Rexburg.
Section 7. AUTHORITY TO DISCONNECT.
If any electrical installation made after the effective date of this code is found to be defective or defectively installed, or
otherwise not in conformity with this code the electrical inspector may order such installation disconnected from the source of
supply until the necessary corrections have been made, provided that the owner of the premises, the tenant, if any, and the
power supply company shall be notified in writing.
Section 8. PERMITS.
(A) Any person, firm or corporation doing any wiring or making any electrical installations in any building, residence or
otherwise, in the City of Rexburg, Idaho, shall make application for and secure a permit to do such work. Fees for such permit
shall be paid on demand. (B) The electrical inspector may cancel said permit at any time, if, in his judgement, the work is not
being done in accordance with the provisions of this Chapter and the person doing such work refuses to correct same to so
comply; and it shall be unlawful for said person to proceed further with such work until such time as he has complied with the
provisions of this ordinance and the instructions of the electrical Inspector. (C) It shall be unlawful for any person, firm or
corporation to connect or energize any electrical installation coming under the provisions of this ordinance unless an electrical
permit covering such installation has been issued by the City Clerk of Rexburg. (D) Permit Fees. The applicant shall pay to
the City Clerk for each permit issued, and at the time of issuance, a fee in accordance with the following schedule:
TEMPORARY SERVICES. A temporary service is a service entrance which will be used for
CONSTRUCTION PURPOSES ONLY, and which will be removed when construction is completed. All
other services are classified as permanent. No inspection fees will be required for temporary services as
herein defined
MINIMUM FEE. The minimum fee for any electrical inspection other than a temporary service, - $3.50.
1. RESIDENTIAL - NEW CONSTRUCTION.
1 room $3.50 5 rooms $7.00 9 rooms $11.00
2 rooms 3.00 6 rooms 8.00 10 rooms 12.00
3 rooms 5.00 7 rooms 9.00 11 rooms 13.00
4 rooms 6.00 8 rooms 10.00 12 rooms& over 14.00
Additional bathrooms, utility rooms, unfinished basements, finished rooms in basements and residential
garages are each to be included as one room.
2. RESIDENTIAL - SERVICE ENTRANCE, REWIRING OR ADDITIONS.
New service entrance or any change in a service entrance and/or installation of any new circuit, distribution panel or feeder,
$3.50. New additions or complete rewiring - same as new construction for number of rooms wired. Inspection will not be
required for minor repairs or alterations where there is no change in the service entrance, no additional circuit is required and
the wiring cost does not exceed $25.00, but the wiring must conform to the provisions of Section 54-1001 of the Idaho Code.
Service entrance for individual trailer or mobile home, $3.50.
3. RESIDENTIAL - ELECTRICAL SPACE HEATING.
1 to 5 KW - $2.00 15 to 20 KW - $5.00 31 to 35 KW - $8.00
6 to 10 KW - 3.00 21 to 25 KW - 6.00 36 to 40 K14 - 9.00
11 to 15 KW - 4.00 26 to 30 KW - 7.00 OVER 49 KW -10.00
4. COMMERCIAL, INDUSTRIAL OR OTHER INSTALLATIONS.
Wiring cost not exceeding $100.00, $3.50. Wiring cost exceeding 100.00 but not exceeding $10,000.00,
$2.50 plus 1% of wiring cost. Wiring cost exceeding $10,000.00, $102.50. plus of 1% of wiring cost
exceeding $10,000.00. The inspection fees listed in this paragraph shall apply to any electrical installation
not specifically mentioned elsewhere in this schedule. The wiring cost shall be the cost to the owner of all
labor and all wiring materials and equipment installed as part of the wiring system. Motors, utilization
equipment, appliances and light fixtures need not be included.
NOTE: Apartment buildings with 3 of more dwelling units and trailer courts with accommodations for two
or more trailers or mobile homes come under this paragraph.
5. ELECTRIC SIGNS AND OUTLINE LIGHTING.
Electric signs not exceeding 60 sq. feet, measured on one side, $3.50 over 60 sq. feet, $6.00. Outline
lighting not exceeding 500 feet of tubing, $3.50 - over 500 feet of tubing - $6.00.
Section 9. STATE LICENSE REQUIRED.
(a) Except as herein provided it shall be unlawful for any person to perform or supervise the actual physical
work of installing electric wiring or equipment to convey electric current unless such person holds a valid journeyman
electrician's license, issued by the Idaho State Electrical Board, Department of Law Enforcement.
(b) Except as herein provided it shall be unlawful for any person, partnership, company, association or
corporation to engage in the business of installing electrical wires or equipment to convey electric current or to enter into
agreements to install such wires or equipment without a valid electrical contractor's license issued
by the City of Rexburg.
EXEMPTIONS. The licensing provisions of this section shall not apply to persons making electrical
installations on their property, to apprentice electricians working under the direct, on-the-job, supervision of licensed
journeyman electricians nor to persons regularly employed to do electrical maintenance work on their employers premises.
Section 10. LIABILITY OF CITY.
This code is not to be construed to relieve from or lessen responsibility or liability of any party owning, operating,
controlling, or installing any electrical wiring or equipment, for damages to person or property caused by any defects therein,
nor shall the City be held as assuming any such liability by reason of the inspection required herein.
Section 11. PENALTY FOR VIOLATIONS.
Any person, firm or corporation who shall violate the provisions of this code, or neglect or refuse to comply with any order or
notice made by the electrical inspector pursuant to the provisions of this code shall. be deemed guilty of a misdemeanor and
upon conviction thereof shall be subject to a fine of not less than twenty-five dollars and not more than three hundred dollars.
Section 12.
All other ordinances and parts of ordinances in conflict herewith are hereby repealed.
Section 13,
This code shall be in full force and effect from and after its passage, approval, and full publication.
