ORDINANCE NO. 464
AN ORDINANCE VACATING AND CLOSING A PORTION OF FOURTH EAST STREET OF THE CITY OF REXBURG,
IDAHO WHICH EXTENDS SOUTH OF THIRD SOUTH A DISTANCE OF APPROXIMATELY 400 FEET FOR THE SOLE AND
EXCLUSIVE USE OF THE OWNERS OF THE ADJACENT REAL ESTATE WHICH EXTENDS SOUTH OF THIRD SOUTH A
DISTANCE OF APPROXIMATELY 400 FEET IN THE CITY OF REXBURG, IDAHO, AS PROVIDED BY LAW.
WHEREAS, H. J. Randall, Henry Dietrich and Kenneth Wood have requested the City Council to vacate and close 19.5 feet on the
West side and 19.5 feet on the East side of 4th East Street which extends South of 3rd South a distance of approximately 400 feet in
the City of Rexburg, Idaho, for the sole and exclusive use of the owners on the East and West side of said 4th East Street which
extends South of 3rd South a distance of approximately 400 feet, and,
WHEREAS, it appears that on or about the 5th day of August, 1965, the City of Rexburg vacated and closed 19.5 feet on the West side
and 19.5 feet on the East side of 4th East street between 2nd South Street and 3rd South Street and it appears that this portion of 4th
East street which extends South of 3rd South a distance of approximately 400 feet should be closed so that it would be the same width
as 4th East between 2nd South and 3rd South, and
WHEREAS, it further appearing that said 19.5 feet on the West and 19.5 feet on the East of said 4th East Street which extends South
of 3rd South a distance of approximately 400 feet is not necessary for the use of the City of Rexburg, Madison County, Idaho, and is
not required for city purposes.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Rexburg, Idaho:
SECTION 1. That 19.5 feet on the west and 19.5 feet on the East of 4th East Street which extends South of 3rd South a distance of
approximately 400 feet in the City of Rexburg, Idaho, be, and the same is hereby vacated and closed for the exclusive use of the
owners of the adjacent real estate on the East and West side of said street as provided by the statutes of the State of Idaho, and title to
said portions of the street so vacated shall revert to the adjoining property owners and the Mayor and City Clerk and directed to
execute to said owners in the name of the City of Rexburg, a Quit Claim Deed to the portions of said street so vacated and closed as
provided by law.
SECTION II. This Ordinance shall take effect and be in full force and effect from and after its passage, approval and due publication
as provided by law.
PASSED BY the City Council of the City of Rexburg, Idaho, this 3rd day of May, 1967.
