ORDINANCE NO. 434
AN ORDINANCE REPEALING SECTION 3 OF ORDINANCE NO. 432, ADOPTED
ON THE SECOND DAY OF JANUARY, 1963, TO THE EFFECT THAT THE TOTAL
COST OF THE JOINT WATER AND SEWER SYSTEM IMPROVEMENTS SHALL
NOT EXCEED $411,000.00, AND ADOPTING A NEW SECTION 3, TO THE
EFFECT THAT THE TOTAL COST OF SAID IMPROVEMENTS SHALL NOT
EXCEED $451,000.00; DECLARING AN EMERGENCY AND PROVIDING FOR
THE EFFECTIVE DATE OF THIS ORDINANCE.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF REXBURG, IDAHO:
SECTION 1: Section 3, of Ordinance No. 432, adopted on the second day of January,
1963, is hereby repealed.
SECTION 2: A new revised Section 3 shall be substituted for the repealed Section 3, to
provide as follows:
Section 3: Improvement Authorized. That the Citys joint water and sewer system shall
be, and the same is hereby ordered to be, improved, bettered and extended by the construction of
a sewerage stabilization pond and interceptor lines, and improvement, betterment and extension
of the municipal sewer collection system; the same is hereby authorized, at a total cost not
exceeding $451,000.00 and the necessity thereof is hereby declared.
Section 3: That an emergency exists and this ordinance is necessary to the immediate
preservation of the public peace, health and safety, and that it shall be in full force and effect
from and after its passage, approval and publication, as provided by law.
