ORDINANCE NO. 428
AN ORDINANCE OF THE CITY OF REXBURG, MADISON COUNTY, IDAHO,
PROVIDING, FOR THE VACATING, ANNULLING, AND DISCONTINUING AS A
PUBLIC STREET CERTAIN PARTS OF THE STREET KNOWN AS AND
REFERRED TO AS EAST THIRD SOUTH, AND PROVIDING FOR THE
REVERTING OF THE TITLE TO SAID PARTS AND PORTIONS SO VACATED TO
THE ABUTTING PROPERTY OWNERS AND PROVIDING THAT THE MAYOR
AND CITY CLERK BE AUTHORIZED TO CONVEY BY DEED THE INTEREST
THAT THE SAID CITY OF REXBURG, MADISON COUNTY, IDAHO, HAS IN
AND TO SUCH STRIPS OR PARCELS OF LAND TO THE ABUTTING PROPERTY
OWNERS.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
REXBURG, MADISON COUNTY, STATE OF IDAHO:
WHEREAS: A portion of East Third South, hereinafter described, in not necessary for
the use of the City of Rexburg, Madison County, Idaho, and is not required for city purposes,
and
WHEREAS: it appears to the Mayor and City Council that it would be for the best
interest of the City of Rexburg, Madison County, Idaho, to have said portion of said street
vacated and annulled and conveyed to the abutting property owners,
NOW, THEREFORE, IT IS ORDERED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF REXBURG, MADISON COUNTY, IDAHO:
SECTION 1. That the following described portion of said East Third South, to-wit:
Between Center Street and First
East Street.
be, and the same is hereby vacated, annulled and discontinued as a part of East Third South of
the City of Rexburg, Madison County, Idaho.
SECTION 2: That title to said portion of the street so vacated shall revert to the adjoining
property owners.
SECTION 3: That the Mayor and City Clerk be, and they are hereby authorized to
convey by deed to the adjoining property owners, whatever interest the City of Rexburg,
Madison County, Idaho, may have in and to the portion of said street so vacated.
