ORDINANCE NO. 421
AN ORDINANCE AUTHORIZING THE TRANSFER OF AN UNDIVIDED ONE
HALF INTEREST IN AND TO CERTAIN REAL PROPERTY OWNED BY THE
CITY OF REXBURG, IDAHO, TO MADISON COUNTY FOR AIRPORT PURPOSES
WITHOUT CONSIDERATION ACCRUING TO THE CITY OF REXBURG, IDAHO.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF REXBURG,
IDAHO:
WHEREAS, the City of Rexburg, is the owner of the following described real property situated
in Rexburg, Madison County, Idaho, to-wit:
All that property lying West of the Rexburg Municipal Golf Course in the W1/2SE1/4,
SW1/4NE1/4, of Section 24, Township 6 North, Range 39 East, Boise Meridian, together
with all water rights of every kind and nature thereunto belonging or in anywise
appertaining.
WHEREAS, the mayor and city council of said city have been petitioned by the members of the
Airport Board to convey and undivided one half interest in and to said above described property
to Madison County, Idaho, in order that Madison County might participate in the maintenance
and operation of said airport, and
WHEREAS, it is the judgement of said council that it is for the best interests of said city to
transfer and convey an undivided one half interest in and to the above described real property to
Madison County for the purpose of maintaining and operating a public airport; that such
conveyance be made to said Madison County without any consideration accruing to the City of
Rexburg, Idaho;
NOW, THEREFORE, BE IT RESOLVED that the City of Rexburg transfer and convey to
Madison County, a political subdivision of the State of Idaho, an undivided one half interest in
and to the above described real property for the purpose of maintaining and operating a public
airport without any consideration accruing to said City of Rexburg, Idaho, for the transfer of said
undivided on half interest in and to said property to Madison County, Idaho.
This ordinance shall take effect and be in force upon and after its passage and publication
as required by law.
