ORDINANCE NO. 402
AN ORDINANCE PROHIBITING THE SALE OF GROCERIES ON
SUNDAY; PROVIDING THE PENALTIES FOR THE VIOLATION OF
THE ORDINANCE; REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH:
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF REXBURG, IDAHO:
SECTION 1. It shall be unlawful for any person or persons in the City of
Rexburg, Idaho, to keep open any store or shop on Sunday for the sale of
groceries in its natural and accepted meaning.
SECTION 2. Any person violating the provisions of this ordinance shall
be guilty of a misdemeanor and shall be punishable by fine of not to exceed
$100.00 and upon failure to pay such fine shall be committed to the custody of the
Chief of Police and confined in the City jail at the rate of $1.50 per day until such
fine is paid in full.
SECTION 3. All ordinances or parts of ordinances insofar as they are in
conflict herewith be, and the same are hereby repealed.
This ordinance shall be in full force and effect from and after its passage,
approval and publication.
