January 3, 2022, An application was received for a plat from Jared Kay. 2. March 28, 2022, Payment was received for the application. 3. March 29, 2022, Application paperwork was completed. 4. March 29, 2022, Infrastructure plans were submitted. 5. July 19, 2022, Plat reviews were initiated. 6. August 1, 2023, Infrastructure plans were approved. 7. July 10, 2023, Plat reviews were approved and sent to applicant. 8. April 19, 2023, Plat was submitted to the County Surveyor for review. 9. July 31, 2023, Plat was approved by the County Surveyor. 10. August 3, 2023, the application was presented to the Planning & Zoning Commission. (22-00002) Trappers Landing Div. 1 Residential Plat – Located at approximately 20 S 12th W, this property is zoned as Medium Density Residential 2 (MDR2). The plat consists of approximately 11.38 acres and will contain 58 lots. – Jared Kay (Action) Vince introduced the Trappers Landing Div. 1 Residential Plat. (video index 0:04:27) Alan reported the Staff’s findings on the plat, mentioning that the Commissioner’s had recently seen the second part of this plat, Trappers Landing Div. 2, located directly East of this plat. He reported there were some challenges with the infrastructure, but those have since been corrected and it has passed Staff’s review and it meets all requirements to be developed. Eric asked about a part of the plat that was blocked out and asked if the area is still blocked out. Alan explained the parcel ownership on the map on the screen. He explained that a road dedication was needed for the project, so the owner to the South joined in on the plat but will not be developing the property at this time. Eric asked if this property has the same zoning as the rest of the plat. Alan answered yes and explained the split. He stated the Commission is only dealing with the MDR2 portion of this tonight. Alan answered it will be dedicated to either the City or the State for the road. He clarified that the little piece was part of the original parcel and was never dedicated. Vince asked about any infrastructure that the developer will be contributing to. Alan answered the developer was included in a traffic impact study and they will have to pick up their share of any additional impact at the traffic light or any additional expansion. He went on to note that they currently have approval from the state. Eric asked about the setbacks, especially to the property directly to the West. Alan replied that the setbacks are correct, that only a 20’ setback was required. He elaborated that the townhomes are only planned to be 2 stories, which will be a similar impact as a 2-story home. Eric expressed that the 20’ setback didn’t seem like enough space between the residents and townhomes and asked if there were any berming requirements. Alan replied that there were none. Vince clarified that the current home is in the County. Alan agreed and specified that the current home is in the impact area. Eric asked about public comment, specifically from a neighboring property owner. Alan reminded him that a plat does not have a public hearing, but that previously, the property owner had written a letter stating he owned animals, animals can smell, and asked for no complaints against his animals. Eric then asked about the location of the North to South road in the middle of the plat and how it aligns with roads North of Highway 33. Alan replied that it was one of the challenges with the rezone, but that it does align with the road North of Highway 33. He further explained that the property owner who is not developing will not have to complete the road until they are ready to develop the rest of their property. Discussion proceeded on the previous rezone application and Vince explained why he voted for the rezone to MDR2 in this location. Aaron commented that this supports that as the County land comes in, the medium density continues along Main Street, as it is not the place for an RR1 zone as it is along a 5-lane collector road. Vince asked for Commissioner discussion. Aaron likes plats because they have staff requirements and ordinance requirements, and the job of the Commission is to confirm the requirements have been met and then approve it. Vince agreed and stated that he fully trusts staff to do their job. Eric commented on the amount of medium density housing that has been approved recently as well as the amount of capacity for unbuilt townhomes in the City. Vince reminded Eric of Alan’s Housing Presentation at the July 20th Meeting. Alan stated that the majority of rezones were LDR1 and LDR2 in the last 5 years, by a wide margin. (208) 359-3020 35 North 1st East Rexburg, ID 83440 Rexburg.org | Engage.Rexburg.org MDR’s have been fairly small, but a small acreage of MDR has a high number of units, where single family tends to have a lower number of units, so you have more acreage with less units. Discussion turned to a property to the South, and the density of it compared to this. Alan explained that neither property is reaching its maximum density in either case, and therefore have a similar density. Aaron clarified that under the current zoning, they could go to 120-130 lots, but they are only going to 58. Alan explained that the plat is not showing the 4-plexes, so the density will be higher than 58 units. The 4-plexes are not required to be platted individually unless it is a condo plat, but the buildings in this case are platted so that each building can be sold. Vince asked for Commissioner opinions. Todd stated he thinks this fits the area, it makes sense, it is a good area as it has been sitting there as weed field for a while. Eric likes the development going that direction and thinks it will be interesting to see what commercial goes there. Aaron added his support, commenting that the land use is not changing and the layout is creative. MOTION: Motion to recommend City Council approve Trappers Landing Division 1 Residential Plat as it has met the staff requirements and the zoning requirements. Planning & Zoning recommendation to approve a residential plat for Trappers Landing Division 1 at approximately 20 S 12th W zoned Medium Density Residential 2 (MDR2) #22-00002 – Alan Parkinson (208) 359-3020 35 North 1st East Rexburg, ID 83440 Rexburg.org | Engage.Rexburg.org Planning & Zoning Administrator Parkinson explained the commercial plat on the east side of this property has been approved and this is the residential part of the plat. Council Member Erickson mentioned his concerns regarding the cattle yard behind the development. The smell from the cattle yard is going to be noticeable. Council Member Johnson asked when the developer plans to begin the construction on this project. P&Z Administrator Parkinson replied, the developer is planning to begin constructing on that project this fall.
