HomeMy WebLinkAboutPZ CUP 1565 N 2nd E Religious Worship in TAG May 4, 2023NOTICE OF PUBLIC HEARING FOR A CONDITIONAL USE PERMIT (CUP) NOTICE IS HEREBY GIVEN, that on May 4, 2023 at 6:30 pm a Public Hearing will be held before the Planning & Zoning Commission of the City of Rexburg, Idaho, at City Hall located at 35 North 1st East, Rexburg, Idaho, regarding a Conditional Use Permit (CUP) (#23 00154) to allow religious worship and meeting house in Transitional Agriculture (TAG) zone, per the Rexburg Development Code as a Conditional Use. The said parcel is located at approximately 1565 N 2nd E in Rexburg, Madison County, Idaho, and more particularly described as follows: Legal Description: Parcel RPR6N40E077203: Township 6 north, range 40 E.B.M., Madison County, Idaho Section 7: The east 110 rods of the SE ¼; Less the Following: Commencing at a point 475 feet west of the southeast corner of the SE ¼ of said section 7, and running thence north 200 feet, thence west 150 feet; thence south 200 feet; and thence east 150 feet to the point of beginning. Also Less: Commencing at a point 1229 feet north of the southeast corner of the SE ¼ off said section 7, and running thence west 217 feet; thence north 200 feet; thence east 217 feet; and thence south 200 feet to the point of beginning. Also Less: Commencing at the southeast corner of said section 7, thence north along the east line of section 7, 200 feet; thence west parallel to the south line of section 7, 225.0 feet; thence south parallel to the east line of section 7 to the south line of section 7, 200.0 feet; thence east along the south line of section 7, 225.0 feet to the point of beginning. Also Less: That portion conveyed to the State of Idaho, Idaho Transportation Board by warranty deed recorded November 2, 1978, as Instrument No. 175542. Parcel RPRXBCA0077753: Part of southeast ¼ of section 7, township 6 north, range 40 east Boise Meridian, Madison County, Idaho, described as: Commencing at the southeast corner of section 7, township 6 north, range 49 east and running thence N 00°14’02” W along the east line of said section 7, 1229.00 feet to the True Point of Beginning; thence S 89°45’58” W, 37.80 feet to a found iron rod with plastic cap, marked PLS 13933; thence continuing S 89°45’58” W, 179.20 feet to a found iron rod with plastic cap, marked PLS 13933; thence N 00°14’02” W, 200.00 feet to a found iron rod with plastic cap, marked PLS 13933; thence N 89°45’58” E, 179.20 feet to a found iron rod with plastic cap, marked PLS 13933; thence continuing N 89°45’58” E, 37.80 feet to the east line of section 7; thence S 00°14’02” E along said section line, 200.00 feet to the Point of Beginning. At such hearing the Planning & Zoning Commission will hear all persons and all objections and recommendations relative to such proposed permit. The City Clerk will also accept written comments at City Hall prior to 4:00 p.m. on May 3, 2023. This notice is given pursuant to the provisions of Section 67-6509 and 67-6511 Idaho Code, and all amendments thereof.
