Hello,
As of today, Wednesday, March 8, 2023, the mylars for University View Condo Plat have not been
presented to the City for signatures.
Per the City of Rexburg’s Development Code (subsection 10.03.080), the timeframe to record the
(22-00142) University View Condo Plat has expired, and the Plat is now considered invalid.
To proceed with the Plat, a new application must be submitted, reviewed, and receive approval from
Planning and Zoning and City Council.

The recording extension for University View was granted approximately two months ago, and no
progress has been seen. I’ve been instructed that if we have not received the mylars by Monday,
March 6th, 2023, the extension will be terminated and the permit will be considered expired,
requiring a new plat application to be submitted, reviewed, and approved to continue.

Good news! I received approval for an exception, but we need the mylars signed and recorded as
soon as possible.

10.03.070 Request For Mylar
Once all revisions from staff reviews, County Surveyor, Commission and/or Council
amendments have been made to the Plat, the City of Rexburg Staff will request the final Mylar
be printed. The final Mylar shall show all revisions.
All plats to be offered for recording shall be on transparent tracing(s) that show all pertinent
information that was approved on the Plat.
The approved Plat is to be recorded on clear Mylar silver emulsion with an overall dimension
of eighteen (18”) inches by twenty-seven (27”) inches. (Idaho Code 50-1304)
Required Certifications.
Signature of the following show approval or completion. Please seek signatures in the
order they are listed.
Professional land surveyor – Surveyor shall state on plat that plat is correct,
accurate, and monuments described have been located, installed, and described
Examining Land Surveyor (Madison County)
Sanitary restriction being lifted (Health Department after approval by D.E.Q.)
Treasurers Certification of taxes paid
City Planning & Zoning Administrator
Certification of plat approval by the City Engineer
Certificate of approval by the City Clerk
Certificate of approval by City Council (Mayor)
Recordation by County Recorder
Development Agreement. Before the Plat will be signed by the City, the Development
Agreement shall be executed and the Development Agreement fees shall be paid.

Mylars are printed and I thought the process of signatures had started. I’m sure we would be willing
to pay for an extension if that were possible. If and exception could be made somehow.
What is the fee for an extension? It seems we missed it by just a little bit. How about a Christmas

Records indicate that the plat was approved by City Council on June 1, 2022. Extensions must be
requested before the expiration date.
Tawnya had previously been working on this plat, do you have any updates on if the mylars were
printed or if you were seeking signatures yet?

Kindi,
It seems we may have been waiting to get paid around the six-month point. Most of the counties
that I work with allow a year from approval to record.
10.03.080 File With County Recorder
The Plat shall be filed with the County Recorder within six (6) months after approval by the Council,
otherwise such approval shall become null and void unless an extension of time is applied for and
granted.
1. Communicate to City. Recording number is communicated to the City Planning & Zoning
office to finalize permit.
2. Extension. One extension of time may be granted, for good cause, by the Planning and
Zoning Commission if such extension is authorized by the Commission prior to the expiration
of the six (6) month period, and provided such extension not exceed an additional six (6)
months.
1. Consistent with Zoning. Also, provided that the extension will be consistent with
then-existing city zoning ordinance requirements, in relation to then-existing
conditions.
2. No additional extensions may be granted.
3. Expiration. If an approved Plat expires, whether as to the entire area proposed for
development or as to yet unbuilt portions of development, then a complete new application
must be submitted prior to reconsideration.
1. An application for reconsideration shall be treated as an original application and shall
be subject o all of the procedures of this chapter
