ORDINANCE NO. 393
AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION BILL OF THE CITY OF REXBURG, IDAHO,
FOR THE FISCAL YEAR 1955-1956; LEVYING TAXES FOR GENERAL RE'lmUE PURPOSES OF SAID CITY
AND FOR INTEREST ON THE BONDED INDEBTEDNESS AND FOR SINKING FUND: AND LOCAL IMPROVEMENT
DISTRICT GUARANTEE FUND: AND APPROPRIATING TO'THE SEVERAL DEPARTMENTS, OFFICES AND FUNDS
OF THE SAID CITY GOVERNMENT SUCH SUMS AS MAY BE NECESSARY OR DEEMED NECESSARY, BY THE
MAYOR AND CITY COUNCIL TO DEFRAY THE EXPENSE AND LIABILITIES OF SAID CITY FOR THE FISCAL
YEAR 1955-1956.
BE IT ORDAINED BY the Mayor and Council of the City of Rexblrg, Idaho:
SECTION 1. This ordinance shall be and is hereby termed the annual Appropriation Bill of the
City of Rexburg, Idaho, for the fiscal year 1955-1956.
SECTION 2. There is hereby levied upon all taxable property within ,the City limits of the City
of Rexburg, and subject to taxation for the City purposes of said City Government at the rates
following: ~:,':
For general revenue purposes eleven (ll) mills on each dollar of assessed valuation.

For Street Lighting purposes four (4) mills on each dollar of assessed valuation.

For interest on outstanding bonds of the Cit1"andl.for sinking fund to pay maturing installments
of such bonds, one (1) mill on each dollar of assessed ~luation~

For streets and alleys fund purposes four (4) mills on each dollar of assessed valuation.
For health and sanitation purposea one (1) mtll on each dollar of assessed valuation.
For municipal library purposes one-half (.5) mill on each dollar of assessed valuation.

For Police Retirement purposes one (1) mill on each dol~ of assessed valuation.
For fire department purposes one and one-half (1.5) mills on each dollar of assessed valuation.
For local improvement district guarantee fund one (1) mill on each dollar of assessed valuation.
SECTION 3. The City Clerk is hereby empowered and directed to certify the foregoing to the
proper officers of Madison County, Idaho, for entry upon the tax rolls of said County for the collection
in the manner provided by law.

SECTION 4. The City Treasurer is hereby empowered and directed to apportion the moneys received
on account of taxes, hereby levied, and from all other sources, to the several funds for which levies
are made and to which moneys are appropriated as in this ordinance provided.
SECTION 5. The revenue for the City of Rexburg for the fiscal year 1955-1956 from all sources
received are hereby appropriated to the several funds and purposes which are hereby declared to be
necessary for such purposes as shown by the Budget of the City heretofore adopted for said fiscal year,
respectively, as follows, to-wit:
A. ADMINISTRATIVE DEPAR~T - GENERAL EXPENSE FUND: From moneys received on account of taxes
levied and other available sources, there is hereby appropriated to the General Expense Fund Adminis-
trative Departments and Sundries, the sum of $28,623.08.
B. LAW ENFORC~T DEPARTMENT: From the moneys received on account of taxes levied and other
available sources, there is hereby appropriated to the Law Enforcement Department the sum of $30,000.00.
C. WATER DEPARTMENT: From the revenue derived from the waterworks system of the CitY'O;\1nng
the fiscal year 1955-1956, the moneys now on hand in the waterworks tund, and other revenues available,
there is hereby appropriated the sum necessary to detray the expenses of operating and maintenance of,.,
said system during the fiscal year 1955-1956, and from such. revenue" and for said plrposes, there is.",
hereby appropriated the sum of $21,960.00.
D. IRRIGATION DEPARTMENT: All moneys received on account of the irrigation system of the City
ot Rexburg, and distribution of water thereby to the inhabitants of the City, are hereby appropriated
to the City Ditch Fund for the payments of salaries, wages and other necessary expense of operation
and maintenance of said irrigation system, there is hereby appropriated to the Ditc~ Fund for such
purposes from moneys not otherwise appropriated, the sum of $4,700.00.
E. STREETS AND ALLEYS AND PARKS DEPARTMENT: From moneys received on account of taxes levied
thereof and other revenues available, there is hereby appropriated to the streets department of the
City ot Rexburg, for maintenance and improvements of public streets and alleys and parks the sum of
$32,800.00.

F. HEALTH AND SANITATION DEPARTMENT: From moneys received on account of taxes levied t.hereot
and other revenu~s available, there is hereby appropriated to the Health and Sanitation Depar~t,
for the maintenance of Public Physician and Nurse, garbage removal and dump ground labor and e'Xpense,
the sum of $9,300.00.
G. LIBRARY FUND: From moneys received on account of taxation and other revenue available there
is hereby appropriated to the Library Department for salary of Librarian the sum of $1,020.00.
H. STREET LIGHTING DEPARTMENT: From the moneys received on account of taxation and other sources
available, there is hereby appropriated to the Street Lighting Department, for the payment of the cost
of street lighting and maintenance, the sum of $5,000.00.
I. AIRPORT DEPARTMENT: From moneys received from taxation and other available sources there is
hereby appropriated to t he Airport Department Fund, for general operating expehs~, the sum ot $1,000.00.

J. BOND INTEREST AND SINKING: From moneys received on account at taxes levied thereat and other
available sources, there is hereby appropriated for the payment at interest on outstanding general
obligation bonds of said City and the payment of maturing installments on such indebtedness, the sum
ot $7,125.00.
K. POLICE RE'!'IR.F.1fi!}lT FUND: From the moneys received on account of taxes levied, there is hereby
appropriated to the Police Retirement Fund, for the payment of retirement benefits, the sum of $1,688.96.
L. All revenues at the City ot Rexburg, received during the fiscal year 1955-1956 not hereby
otherwise appropriated, are hereby appropriated to the General Fund of the City.
M. RECREATION DEPARTMENT: From moneys received on account of taxes levied and other sources
available, there is hereby appropriated to the Recreation Department the sum of $754.00:
N. LOCAL IMPROVWENT DISTRICT GUARANTEE: From moneys received on account of taxes levied and
other soUrces available, there is hereby appropriated to the Local Improvement District Guarantee Fund
the sum of $1,688.96.
SECTION 6. This ordinance shall take effect and be in force from and after its passage and pub-
lication as required by law.

AN ORDINANCE CONFIRMING THE ASSESSMENT ROLL FOR LOCAL IMPRO~T DISTRICT NO. 14 IN
REXBURG, IDAHO, FOR CONSTRllCTION AND RE-CONSTRUCTION OF CURBS AND GUTTERS AND THE CONSTRUC-
TION OF DRAINAGE WORKS INCIDENTAL TO SAID IMPROVFXENTS WITHIN SAID DISTRICT: ORDERING
ASSESSl4ENTS TO BE MADE IN ACCORDANCE WITH THE ASSESSMENT ROLL AND PRESCRImNG DETAILS
CONCERNING SAID ASSESSUENTS. ."
WHEREAS, the City Council of the City of Rexburg, Idaho, has created withln said City Local .
Improvement District No. 14, f~ Rexburg, Idaho, tor the purpose of construction and re-construction
of curbs and gutters and the c~truction of drainage works incidental to said improvements within
said district, and

WHEREAS, the committee on streets of said Council, together with the City Engineer, made out an
assessment roll for said district pursuant to the la~of the State of Idaho and of said City and
certified said roll to said COWlcil, and ''ft;.
WHEREAS, said Council caused said roll to be filed in the office of the City Clerk on the 27th
day of June, 1955, and gave the requisite legal notice that written objections to said roll might be
filed with the City Clerk and that said Council would hear and consider any written objections on
Wednesday, July 13, 1955, at 8 .o'clock p.m. at the City Hall in said City, and
WHEREAS, said Council met at said place and date to hear and consider all objections filed, and
WHEREAS, the clerk reported that no written objections were filed and no person appeared at said
Council meeting with oral obj eqtions,
Ncm, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of Rexburg, Idaho:
SECTION I. The City Council of the City of Rexburg, Idaho, hereby confirms the assessment roll
certified and filed with the City Clerk for Local Improvement District No. 14 for Rexburg, Idaho, for
the construction and re-construction of curbs and gutters and the construction of drainage works
incidental to said improvements within said district, and hereby orders the levy of the assessment
shown in said roll and hereby levies against each lot and parcel of land shown in said roll the amount
of assessment listed therein. .
SECTION II. The City Clerk shall immediately certify and file said roll with the City Treasurer
and said assessments shall be due and payable to the City Treasurer twenty days from the date of the
publication of this ordinance, being the date of the confirmation of said roll, and if not paid within
thirty days thereafter shall become delinquent, provided that all such assessments, or any part
thereof, may at the election of the owner be paid in installments with interest as hereinafter pro-
vided. Failure to pay the whole assessment within said period of thirty days shall be conclusively
considered and held an election on the part of all persons interested, either under disability or
otherwis.e, to pay in such installments herein. In case of such election to pay in installments, the
unpaid assessment shall be payable to said City Treasurer in ten substantially equal annual install-
ments ot prinCipal, the first of which installments of principal shall be due and payable on or before
the 8th day of August, 1956, and the remainder of said installments shall be due and payable successively
on or before the same day in each year thereafter until paid in full, with interest in all cases on
the unpaid and deterted installments of principal from the 8th day of August, 1955, at the same rate
of interest as that provided for in the special assessment bonds to be hereafter authorized, solq.
issued and delivered, but not to exceed seven per cent per annum., payable annually at the ottice"of
