AN ORDINANCE CREATING LOCAL IMPROVEMENT DISTRICT NO. 14 IN REXBURG, IDAHO,
FOR THE PUHPOSE OF CONSTRUCTING AND HECONSTHUCTING CURBS AND GUTTERS:

NOTICE FOF CONSTRUCTIO\J BIDS: A:m DECLARING AN ElLSRGENCY.
TimERE-AS, on the 16th d::y of February, 1955, the City Council of the City of Rexburr~,
Madison County, Idaho, adopted a Resolution declarinr; the intention to construct and re-
construct curbs and eutters and the con~3truction of drainage 'Norks incident21 to said
improvement.s, and to create Llprovement District No. 14 for the construction and reconstruc-
tion of said curb~J and ,c;utter:3 and d.l'ainage rlOrks incidental to said improvements, which
re:301ution authorized the publication and mc1iling of notice of intention to construct such
improvements and to create such Local Improvement District, and
WHEREAS, such notice was duly pubH:3hed and mailed as provided by la'."J; and
'flHEREAS, in response to such published and mailed notice there were filed with the
City Clerk of said City or in her office five protests a~ainst the construction of the
proposed improvements or the creation of said Local Improvement District, or both; and
1.!mEREAS, on the 9th day of March, 1955, at the hour of 8 o'clock P. M., the City Gouncil
of said City met for the purpose of hearing protests against the construction of said
improvements or the creation of said Local Improvement District, or both, and
7lHEREAS, the City Council has duly considered each and every written protest so filed
and has full,)' heard each and every person who 'Nished to be heard vlith regard to the ~onstruc-
tion of said improvement~3 or the creation of said District; and
~VHEREAS, said protests were not made by the owners of more than two-thirds of the
abutting, adjoining, contiguous and adjacent lots and lands within said proposed District,
and
'NFIEfiEAS, all of said protests were duly overruled and denied; and
TNI1:1:::;REAS, the City Engineer has made estimates of the cost of all labor and material
for the construction of the proposed improvements in said District, such estimate of total
cost being the sum of $149,697.00; and
WHEREAS, a portion of such total cost is to be assessed upon and against the property
within said District to be benefited by the construction of said improvements; and
iTJIEREAS, all preliminary steps and proceedings necessary for the creation of said
Improvement District and the construction of the proposed improvements therein have bc;cn
duly taken and adopted;
THEREItORE,' BE IT ORDAINED BY THE Mayor and the Council of the City of Rexburg, Idaho:
Section 1. That there shall be and there hereby is created a local improvement
district in the City of Rexburg, Idaho, to be known and designated "Local Improvement
District No. 14, City of Rexburg, Idaho," which shall include all of the lots, lands and
parcels, of real property within the boundaries of said District.

Section 4. In the judgment of the City Council of the sai<f City, it is fair and equitableJl.
that $10,543.00 of said total cost be paid by said City from its gen6lA1 f,undfor the cost !"d .
expense of street and alley intersections within the proposed Dis~ricfJi and in aqdition thereto, ~',
the said City shall pay the costs and expenses of improvement~ to be constructed on streets
and avenues adjoining lots and lands owned by the City of Rexburg. The costs and expenses of
the proposed improvements to be assumed and paid by the said City. are deemed to be fair and
equitable in consideration of the public benefit to be derived by said City from the construc-
tiDn of said irnprovements.
Such part of the cost and expenses of the proposed improvements as is not paid or assumed
hy tile City shall be assessed against the lots and lands abutting, a.djoining, contiguous or
adjacent to the proposed improvements to the center of the block facing said improvements.

Section 5. Each lot and parcel of land shall be separately assessed for its share ~r the
costs and expenses of constructing said improvements in proportion to the number of square feet
of such lots and parcels of land abutting, adjoining, contiguous and adjacent thereto or .
included within said District to the distance back from such street, if pl~ted in blocks to
the center of the block, if platted in lots to the center of the lots, an~if not platted, to
the dbtance of 125 feet in proportion to the benefits to be derived fromSUch improvements,
sufficient to cover all of the portion of the cost and expense of the work,to be so levi~d and
assessed to the center of the street..

Section 6. The committee on streets and the City Engineer are hereby:directed to pr~pare
an assessment roll according to the provisions of this Ordinance and the law under which said
Improvement District is created after contracts for the construction of said improvements have
been let; said assessment roll shall contain, among other things, the number of the assessment,
the name of the owner if known, or if not known a statement to that effec\,.a description of
each lot or tract assessed and the total amount of the assessment; which as~essment roll, upon
its completion, shall be certified to the City Council by said Committee on streets and said
City Engineer. Whereupon the City Council will fix a time when objections thereto by the
property mvners in said District will be heard and will cause such assessment roll to be
filed in the office of the City Clerk.

Section 7. The Mayor and City Clerk shall give public notice callin~ for hid:, for
constructirL';' said improvements, in three consecutive weekly issue~3 of the Rexburr; Stand2.rd,
the official ne'!iSpaper of said City, 1!Jhich notice shall state the time, place and hour when
and where the City Clerk will receive sealed proposals for the construction of such improve-
r.1C~nts, and 'Nhich notice shall contain a r.:eneral dec,cription of the kind and amount of work
to be done, the materials to be furnished, a:3 nearly accurate as practicable, usi' :,uch
g.meral terms as to adroit of the widest latitude for competition, and shall st; t "hat the
plans and specifications for said improvements are on file in t he offices of th.:; :.aty
Engineer and the City Clerk, and may be examined or obtained at either office. The notice
shall also ,state the amount of the estimate of the cost of said improvements, and that each
bidder shall accompany his bid with a certified check or bid bond in the amount of 5 per cent
of the bid in case the contract is a1Jarded to such bidder and he fails or refuses to enter
into the contract and give the bond required, the proceeds of such check to be forfeited to
the City as liquidated damages and placed in the Local Improvement Fund for said District.
