ORDINANCE NO. 386, CONT.
C. WATER DEPARTMENT: From the revenue derived from the V'Taterworks system of the City during
the fiscal year 1953-1954, and the moneys now on hand in the waterworks fund, and other revenues
available, there is hereby appropriated the sum necessary to d.i;fray the expenses of operating
and maintenance of said system during the fiscal year 1953-1954, and from such. revenue, and for
said purposes, there is hereby appropriated the sum of ,;$23,160.00.
D. IRRIGATION DEPAHTMENT: All moneys received on account of the irrigation system of the
City of Rexburg, and distribution of v~ter thereby to the inhabitants of the City, are hereby
appropriated to the City Ditch Fund for the payments of salaries, wages and other necessary
expense of operation and maintenance of said irrigation system, there is hereby appropriated to
the Ditch Fund for such purposes from monies not otherwise appropriated, the sum of ~;;3,550.00.
E. STREETS AND ALLEYS DEPARTMENT: Fronl moneys received on account of taxes levied thereof
w1d other revenues available, there is hereby appropriated to the streets department of the
City of Rexburg, for maintenance and improvements of public streets and alleys the sum of
$28,500.00.
F. HEALTH AND SAl'JITATIOIJ DEPARTMENT: From moneys received on account of taxes levied thereof
and other revenues available, there is hereby appropriated to the Health and Sanitation Department,
for the maintenance of Public Physiciw1 and Nurse, garbage removal and dump ground labor and
expense, the sum of ~$8,550.00.
G. LIBBA2Y FUND: From moneys received on account of taxation and other revenue available
there is hereby appropriated to the Library Department for salary of Librarian the sum of
~;?1,020.00.
H. STREET LIGHTING DEPARTHENT: From the moneys received on account of ta.,"{ation and other
sources available, there is hereby appropriated to the Street Liehting Department, for the
payment of the cost of Street Lighting and maintenance, the sum of ~p4,000.00.
I. AIm'ORT DEPARTMENT: From moneys received from taxation and other available sources there
is hereby appropriated to the Airport Department Fund, for general operating expense, the sum
of $1,500.00.
J. BOND INTEHEST AND SI?~ING: From moneys received on account of taxes levied thereof and
other available sources, there is hereby appropriated for the payment of interest on outstanding
general obligations bonds of said City and the payment of maturing instalments on such
indebtedness, the sum of $7,112.50.
K. POLICE RETIHElUlliT FUND: From the moneys, received on account of taxes levied, there is
hereby appropriated to the Police Retirement Fund, for the payment of retirement benefits, the
sum of $1,500.00.
L. All revenues of the City of Rexburg received during the fiscal year 1953-1954 not
hereby othe~1ise appropriated, are hereby appropriated to the General Fund of the City.
11. RECHEATION DEPARTMENT: From moneys received on account of taxes levied and other
available sources, there is hereby appropriated to the Recreation Department the sum of $788.24.
SECTION 6. This ordillance shall take effect and be in Jorce from and after its passage
and publication as requireq by law.

AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION BILL OF THE CITY OF REIBURG,
IDAHO, FOR THE FISCAL YEAR 1954-1955: LEVITNG TAXES FOR GENERAL REVH'....NUE PURPOSES
OF SAID CITY AND FOR INTEREST ON THE BONDED INDEBTEDNESS AND FOR SINKING FUND:
AND APPROPRIATING TO THE SEVERAL DEPARTMENTS, OFFICES AND FUNDS OF THE SAID
CITY GOVERNMENT SUCH SUMS AS MAY BE NECESSARY OR DEWED NECESSARY, BY T HE MAYOR
AND CITY COUNCIL TO DEFRAY THE EXPENSE AND LIABILITIES OF SAID CITY FOR THE
FISCAL YEAR 1954-1955.
AND BE IT ORDAINED BY the Mayor and Council of the City of Rexburg, Idaho:
SECTION 1. This ordinance shall be and is hereby termed the Annual Appropriatio~ Bill
of The City of Rexburg, Idaho, for the fiscal year 1954-1955.
SECTION 2. There is hereby levied upon all taxable property within the City limits of
the City of Rexburg, and subject to taxation for the City purposes of said City Government
at the rates following:

For general Revenue purposes ten (10) mills on each dollar of assessed valuation.

For street Lighting purposes three and one-half (3.5) mills on each dollar of assessed
valuation.

For interest on outstandiw,; bonds of the City, and for sinking fund to pay maturing
installments of such bonds, three (3) rTlills on each dollar of assessed valuation.
For streets and alleys fund purposGs four (4) mills on each dollar of assessed valuation.
For health and sanitation purposes one, (1) mill on each dollar of assessed valuation.

For municipal library purposes one-half (.5) mill on each dollar of assessed valuation.
For city park purposes three (3) .nills on each dollar of assessed valuation.

For Police Retirement purposes one (1) mill on each dollar of assessed valuation.
For recreation fund purposes one-half (.5) mill on each dollar of assessed valuation.
For fire department purposes one and one-half (1.5) mills on each dollar of assessed
valuation.
SECTION 3. The City Clerk is hereby empowered and directed to certify the foregoing to
the proper officers of Madison County, Idaho, for entry upon the tax rolls of said County for
the collection in the manner provided by law.
SECTION 4. The City Treasurer is hereby empowered and directed to apportion the moneys
received on account of taxes hereby levied, and from all other sources to the several funds for
which levies are made and to which moneys are appropriated as in this ordinance provided.
SECTION 5. The revenue for the City of Rexburg for the fiscal year 1954-1955 from all
sources received are hereby appropriated to the several funds and purposes which are hereby
declared to be necessary for such purposes as shown by the Budget of the City heretofore adopted
for said fiscal year, respectively, as follows, to-wit:
A. ADMINISTRATIVE DEPARTMENT - GENERAL EXPENSE FUND: From moneys received on account of
taxes levied and other available sources, there is hereby appropriated to the General Expense
Fund Administrative departments and Sundries, the sum of $28,623.08.
B. LAW ENFORCEMENT DEPARTMENT: From the moneys received on account of taxes levied and
osher available sources, there is hereby appropriated to the Law Enforcement Department the sum
of $30,000.00. ,>

c. WATER DEPARTMENT: From the revenue derived from the waterworks system of the City
during the fiscal year 1954-1955, and the moneys now on hand in the waterworks fund, and other
revenues available, there is hereby appropriated the sum necessary to defray the expenses of
operating and maintainance of said system during the fiscal year 1954~1955, and from such
revenue, and for said purposes, there is hereby appropriated the sum'of $21,960.00.
D. IRRIGATION DEPARTMENT: All moneys received on account of the irrigation system of the
City of Rexburg, and distribution of water thereby to the inhabitants of the City, are hereby
appropriated to the City Ditch Fund for the payments of salaries, wages and other necessary
expense of operation and maintenance of said irrigation system, there is hereby appropriated to
the Ditch Fund for such purposes from monies not otherwise appropriated, the sum of $4,700.00.

E. STREETS AND ALLEYS AND PARKS DEPARTMENT: From moneys received on account of taxes
levied thereof and other revenues available, there is hereby appropriated to the streets
department of the City of Rexburg, for maintenance and improvements of public streets and alleys
and parks th~ sum of $32,800.00.

F. HEALTH AND SANITATION DEPARTMENT: From moneys received on account of taxes levied
thereof and other revenues available, there is hereby appropriated to the Health and Sanitation
Department, for the maintenance of Public Physician and Nurse, garbage removal and dump ground
labor and expense, the sum of $9,300.00. .
G. LIBRARY FUND: From moneys received on account of taxation and other revenue available
there is hereby appropriated to the Library Department for salary of Librarian the sum of
$1,020.00.
H. STREET LIGHTING DEPARTMENT: From the moneys received on account of taxation and other
sources available, there is hereby appropriated to the Street Lighting Department, for the
payment of the cost of Street Lighting and maintenance, the sum of $5,000.00.
I. AIRPORT DEPARTMENT: From moneys received from taxation and other available sources
there is hereby appropriated to the Airport Department Fund, for general operating expense, the
sum of $1,000.00.

J. BON~ INTEREST AND SINKING: From moneys received on account of taxes levied thereof
and other av~lable sources, there is hereb~ appropriated for the payment of interest on
outstanding general obligation bonds of said City and the payment of maturing installments
on such indebtedness, the sum of $7,125.00.
K. POLICE RETIREMENT FUND: From the moneys received on account of taxes levied, there is
hereby appropriated to the Police Retirement Fund, for the payment of retirement benefits, the
sum of $1,629.12.
L. All revenues of the City of Rexburg received during the fiscal year 1954-1955 not
hereby otherwise appropriated, are hereby appropriated to the General Fund of the City.

M. RECREATION DEPARTMENT: From moneys received on account of taxes levied and other
sources available, there is hereby appropriated to the Recreation Department the sum of $814.56.
SECTION 6. This ordinance shall take effect and be in force from and after its passage
and publication as required by law.

ORDINANCE NO. 388
AN ORDINANCE AMENDING SECTION 11 OF ORDINANCE NO. 358 OF THE CITY OF.REXBURG,
PERTAINING TO THE LOCATION OF BUILDINGS ON LOTS.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, MADISON COUNTY,
IDAHO:
Section 1: That Section 11 of Ordinance No. 358 be, and the same is hereby amended to
read as follows:
"In the business or commercial district, the buildings may be placed to the property line.
But in the residential districts, there must be at least 20 feet between the front of the
building and the property line, and a minimum width of 5 feet for the back yards and side
yards from the adjoining property line. However, a minimum distance of ten (10) feet must be
maintained from the wall to an existing or future opposing structure or obstruction.
"No structure of any kind which might obstruct the view shall be put on a corner lot
of intersecting streets nearer than 20 feet from the street property line.
"The City Council has the authority to grant special exceptions to these rules when
thought to be for the best interests to the public."
