ORDINANCE NO. 384
AN ORDINANCE DEElilNG IT ADVISABLE TO ISSUE MUNICIPAL COUPON BONDS OF THE CITY OF
REXBUHG, MADISON COUNTY, STATE OF IDAHO, IN 'l'HE AMOUNT OF ~;;60,000.00, FOR THE
PURPOSE OF REMODELING 'rEE CITY HALL AND ERECTING AND CONSTRUCTING ADDITIONS
THERETO AND FURNISHING THE SAME IN THE AMOUNT OF $60,000.00, SUCH IillJODELING
AND ADDITIONS TO INCLUDE, AMONG OTHEH THINGS, ROOMS FOR A PUBLIC LIBRAHY AND LADIES
REST ROOM, WHICH IS A NECESSARY PUBLIC IMPHOVEMENT; PROVIDING FOR A SPECIAL
ELECTION OF- SAID CITY TO VOTI~ UPON THE QUESTION OF ISSUING SUCH BONDS AND
SPECIFYING PROVISIONS TO BE MADE FOR THE PAYMENT OF SUCH BONDS.
VffiEREAS, It is deemed necessary at this time that the City Hall be remodeled and that
additions thereto be erected and constructed and that the same be furnished, such additions to
include, among other things, rooms fo~ a public library and ladies rest room; that the cost of
remodeling the City Hall and constructing and building additions thereto and furnishing the
same will be $60,000.00, and
VffiEREAS, the City of Rexburg, Idaho, does not have funds available for said purposes, and
WHEREAS, it is deemed advisable by this City Council that municipal coupon bonds of said
city in the amount of Sixty Thousand Dollars ($60,000.00) be issued and sold for such purposes,
NOW, THEREFORE, BE IT ORDAINED BY TI-IE MAYOR AND COUNCIL OF THE CITY OF REXBURG, MADISON
COUNTY, STATE OF IDAHO:
Section 1. That it is deemed advisable by the City Council that municipal bonds of the
City of Rexburg in the amount of $60,000.00 be issued and sold to provide funds for the purpose
of remodeling the City Hall and erecting and constructing additions thereto and furnishing the
same, in the amount of $60,000.00, such additions to inClUde, among other things, rooms for a
public library and ladies rest room, which is a necessary public improvement.
Section 2. That such bonds shall bear interest at a rate not to exceed four per cent per
annwn, payable semi-annually, and shall mature and be payable upon an annual amortization plan,
the first annual amortized principal payment to. mature and be payable at the expiration of
two years from and after the date or' the bonds, and the last annual amortized principal payment
to mature and be payable a.t the expiration of twenty years from and after the date of the bonds,
and the various annual maturities shall be, as nearly as practicable, in such principal amounts
as vdll, together with the accruing interest on all outstanding bonds of such issue, be met
and paid by an equal annual tax levy for the payment of the principal of said bonds and interest
thereon during the term for which such bonds shall be issued in accordance vdth provisions of
Section 50-2811 Idaho Code, and the Municipal Bond Law of Idaho; that said bonds shall be in
denoninations.Gf Five Hundred Dollars ($500.00) or 1ID.1ltiples thereof, numbered consecutively,
beginning with the number one, the bonds being payable in numerical order, the lowest number first.
Section 3. That for the purpose of providing funds to pay the interest on said bonds promptly
when the same falls due and also a sinking fund for the payment of said bonds at maturity, there
shall be levied 'annually upon all of the taxable property in said city, in addition to all other
taxes, a sum sufficient to! pay the interest on said bonds and to provide for the payment of the
principal thereof as they ~ture, and all such taxes must be levied, assessed, and collected
as other taxes until the bpnds so issued are fully paid and the faith, credit and all taxable
property within the sai~ clity are and must continue pledged for the punctual payment of the
principal of and the interbst on said bonds when due. .
Section 4. That a s~cial election o~ the quali,fied electors who are taxpayers of the City
of Rexburg, Idaho, be and ~he same is hereby called to be held on Tuesday, the 28th day of April,
1953, for the purpose of epabling the qualified elect9rs Vlho are taxpayers of said city to vote
upon the question of issuipg said bonds. That at said election the voting places and the
officials serving t:t'1ereat shall be as follows: .

Section 5. The polls shall open at the hour of 9 0 I clock A.M. on said day and shall remain
open continuously until the hour of 7 0 I clock P.M. of said day, at v~Thich time the polls shall
be closed.
Section 6. .. The voting at such election shall be by ballot in sUbstantially the following

In favor of issuing bonds in the amount of ~~6o,ooO.OO for the
purpose of remodeling the City Hall and erecting and constructing
additions thereto and fUrnispingthe same, such remodeling and
additions to include, among other things, rooms for a public
library and ladies rest room, as described in Ordinance No. 384,
signed and approved March 5, 1953.
Against issuing bonds in the amount of $60,000.00 for the purpose
of remodeling the City Hall and erecting and constructing additions
thereto and furnishing the same, such remodeling and additions to
include, among other things, rooms for a public library and ladies
rest room, as described in Ordinance No. 384, signed and approved
pn the 5th day of March, 1953.

(Instructions to Voter: The voter must make a cross thus "X" in
the square opposite the answer for which he intends to vote.)
Which ballots shall be furnished by the City Clerk to the Judges of election to be by them
furnished to the voters. At said election only those persons who are qualified electors and who
are taxpayers in the City of Hexburg, Idaho, shall be permitted to vote.
Section 7. Thirty days notice of such s.pecial bond election shall be given by publishing
notice of election in the Hexburg Standard, a weekly newspaper printed and published in the
City of Rexburg, Idaho, for six consecutive issues thereof, and by posting such notice for a
similar length of time in three (3) public places in each .Yard in said city, which notice shall
be in substantially the following form.:
"NOTICE OF OOND ELECTION
PUBLIC NOTICE IS HEREBY GIVEN that a special election of the qualified electors of the City
of Rexburg, Idaho, who are taxpayers therein will be held in said city on the 28th day of April,
1953, for the purpose of voting upon the following question:
Shall bonds of the City of Rex.burg, Madison County, State of Idaho, in the total
amount of $60,000.00 bearing -interest at the rate of not to exceed four per cent
per annum and maturing serially on an amortization plan as required by the
municipal bond law of the State of Idaho, the first installment of principal to
be due and payable at the expiration of two years from the date of said bonds
and th~ last. in.stallment of said principal to due and payable at the expiration
of twe~ty years from the date of said bonds, said bonds to be issued and sold to
provide funds for the purpose of remodeling the City Hall and constructing
additions thereto and furnishing the same in the amount of $60,000.00, such
remodeling 'and additions to include, among other things, rooms for a public
library and: ladies rest room, which is a necessary public improvement, as
provided in'Ordinance No. 384.
At such election only those qualified electors who are taxpayers in the City ~f Rexburg,
Idaho, will be permitted to vote.

Loretta M. Rigby, City Clerk, is ex-officio registrar of said city. The place of registration
is the office of said City Clerk at the City Hall.
Persons may register on each.day at any time during the office hours of said Clerk,
beginning vnth the day that the Notice of Election is given and continuing until and including
the Saturday next preceding the election, persons may register between the hours of 9 o'clock
A.M. and 5 o'clock P.M. and between the hours .of 7 o'clock P.11. and 9 o'clock P.M.
The voting at said election shall be by ballot. The ballot to be supplied the voters for
their use at siad election shall be in the form set out in Ordinance No. 384.

Section 8. If at such election tVl'o-thirds of the qunlified electors who are taxpayers in
such city voting at such election assent to the issuing of such bonds they shall be issued in
manner provided by the "Municipal Bond Law'1 of the state of Idaho.
Section 9. This ordinance, upon its passage and approval, shall be published in one issue
of the Rexburg Standard, a weekly newspaper printeci and published ani of general circulation in
the City of Rexburg, IdahQ, and shall take effect and be in full force immediately upon its
passage, approval, and publication.
Section. 10. All orcqna.nces or parts of ordinances of the City of Rexburg, Idaho, in conflict
with this ordinance or ant part hereof are hereby repealed.

AN ORDINANCE PROVIDING FOR FIRE PREVENTION AND PROTECTION IN CONNECTION WITH
HAZ/~HOOUS MATElUALS AND PROCESSES.
BE IT O~~I~ED BY THJ~ MAYOR AND THE CITY COUNCIL OF THE CITY OF REXBURG, IDAHO:
Section i: There is hereby adopted by the City of Rexburg for the purpose of providing for
fire prevention and protection in connection with hazardous materials and processes that certain
code known as the 'Fire Prevention COde, Abbreviated Edition, recommended by the National Board
of Fire Undervlriters 'of New York, being particularly the 1950 edition thereof, and the whole
thereof, save and except such portions as are hereinafter deleted, modified or amended, of which
not less than 'tnree copies have geen and now are filed in the office of the Clerk of the City
of Rexburg, and the same are hereby adopted and incorporated as fully as if set out at length
herein, and from the date on which this ordinance shall take effect, the provisions thereof
shall be ~o~t~oll~ within the limits of the City of Rexburg.
Section2i' Wherever the word "Municipality" is used in said code, it shall be held to mean
the City ~~ R~ibu~g~
"';; Section '3: . 'The limits in Section 312 of this code in which bulk storage and flammable
liquids i~,ou~s~d~:above ground tanks is prohibited, are hereby established as follows:
Closely built up, mercaritile and residential areas, such areas to be defined
and deterniiried by the City Council.
