ORDINANCE NO. 382
AN ORDINANCE AMENDING SECTION 15 OF ORDINANCE NO. 249 OF THE CITY OF REXBURG PREVENTING
THE USE OF VEHICIES OR EClUIPMENT ON THE PUBLIC STRlli'TS OF THE CITY OF REXBURG
INJURIOUS TO SUCH PUBLIC STll>S AND PLACING RESTaICTIONS AS TO TIRE EQUIPMENT.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, MADISON COUNTY, IDAHO:
SECTION I: That Sectionil5. of Ordinance No. 249 be, and the same is hereby amended to read
as follows:
Every solid rubber tire on a vehicle moved on any public street of the City of Rexburg shall
have rubber on its entire traction surface at least one inch thick above the edge of the flange
of the entire periphery.
SECTION II: No metal tired vehicle shall be operated over a public street if such vehicle
has on the periphery of any of th~ road wheels any lug,. flange, cleat, ridge, bolt, or any
projection of metal or wood which projects radially beyond the tread or traffic surface of the
tire, unless the public street is protected by putting down solid planks or other suitable
material, or by attachm~nt~ to the "heels so as to prevent such vehicles from damaging the public
streets, except that this prohibition shall not apply to tractors or traction engines equipped
with what i8 known as caterpillar treads, when such caterpillar does not contain any projection
o! any kind likely to injure the surface of the public streets: provided, hmvever, that tractors,
traction engines, and similar vehicles IDa'y be operated which have upon their road wheels "V"
shaped, diagonal and other cleats arranged in such a manner as to be continuously in contact ,
with the road surface.

WHEREAS, it is deemed necessary at this time that the City Hall beremode1.ed and that

VJHEREAS, it is deemed advisable by this City Council that municipal ;t>upon bonds of said
City in the amount of Seventy-five Thousand Dollars ($75,000.00) be issued and sold for such

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, MADISON
COUNTY, STATE OF IDAHO:
Section 1. That it is deemed advisable by the City Council that municipal bonds of the City
of Rexburg in the amount of $75,000.00 be issued and sold to provide funds for the purpose of
remodeling the City Hall and erecting and constructing additions thereto and furnishing the
same, in the amount of $60,000.00, such additions to inClude, among other things, rooms for a
public library and ladies rest room, and for the purpose of erecting and constructing and
furnishing a public building for the use of the City of Rexburg, Idaho, as a storage building
for said city equipment in the amount of $15,000, all of which are necessary public improvements.

Section 2. That such bonds shall bear interest at a rate not to exceed four per cent per
annum, payable semi-annually, and shall mature and be payable upon an annual amortization plan,
the first annual amortized principal payment to mature and be payable at the expiration of two
years from and after the date of the bonds, and the last annual amortized principal payment to
mature and be payable at the expiration of twenty years from and after the date of the bonds,
and the various annual maturities shall be, as nearly as practicable, in such principal
wnounts as vdll, together with the accruing interest on all outstanding bonds of such issue, be
met and paid by an equal annual tax levy for the payment of the principal of said bonds and
interest thereon during the term fa r 'which such bonds shall be' issued in accordance with
provisions of Section 50-2811 Idaho Code, and the Municipal Bond Law of Idaho; that said bonds
shall be in denominations of Five Hundred Dollars ($500.00) or multiples thereof, numbered
consecutively, beginning with the number one, the bonds being payable in numerical order, the
lowest number first.

Section 3. That for the purpose of providing funds to pay the interest on said bonds promptly
vmen the same falls due and also a sinking fund for the payment of said bonds at maturity, there
shall be levied annually upon all of the taxable property in said City, in addition to all other
taxes, a sum sufficient to pay the interest on said bonds and to provide for the payment of
the principal thereof as they mature, and all such taxes must be levied, assessed and collected
as other taxes until the bonds so issued are fully paid and the faith, credit and all taxable
property within the said City are and must continue pledged for the punctual payment of the
principal of and the interest on said bonds when due.
Section 4. That a special election of the qualified electors who are taxpayers of the City
of Rexburg, Idaho, be and the same is hereby called to be held on Tuesday, the 10th day of
February, 1953, for the purpose of enabling the qualified electors who are taxpayers of said
City to vote upon the question of issuing said bond. That at said election the voting places
and the officials serving thereat shall be as follows:

Which ballots shall be furnished by the City Clerk to the Judges of election to be by them furnished
to the voters. At said election only those persons who are qualified electors and who are tax-
payers in the City of Rexburg, Idaho, shall be permitted to vote.

Section 7. Thirty days notice of such special bond election shall be given by publishing notice
of election in the Rexburg Standard, a weekly newspaper printed and published in the City of
Rexburg, Idaho, for five consecutive issues thereof, and by posting such notice for a s:i.milar
leIloooth of time in three (3) public places in each ward in said City, which notice shall be in
substantially the following form:
"NOTICE OF BOND ELECTION
PUBLIC NOTICE IS HEREBY GIVEN that a special election of the qualified electors of the City
of Rexburg, Idaho, who are taxpayers tlfuerein .will be held in said City on the loth day of
February, 1953, for the purpose of voting upon the follcwting question:
Shall bonds of the City of Rexburg, Madison County, State of Idaho, in the total

Persons may register on each day at any time during the office hours of said Clerk, beginning
vdth the day that the Notice of Election is given and continuing until and including the
Saturday next preceding the election, persons may register between the ho'~rs of 9 o'clock A.M.
and 5 o'clock P.B:. and between the hours of 7 o'clock P.M. and 9 o'clock ?M.

The voting at said election shall be by ballot. The ballot to be supplied the voters for
their use at said election shall be in the form set out in Ordinance 'No.~82.

Section 9. This ordinance, upon its passage and approval, shall be published in one issue
of the Rexburg St2ndard, a weekly nevTSpaper printed and published and of gener'al circulation
in the City of Rexburg, Idaho, and shall take effect and be in full force immediately upon its
passage, approval and publication.
Section 10. All ordinances or parts of ordinances of the City of Rexburg, Idaho, in
conflict ,nth this ordinance or any part hereof are hereby repealed.
