AN ORDINANCE FOR THE ORGANIZATION AND REGULATION OF THE CITY OF REXBURG FIRE DEPARTIJENT AND PROVIDING
FOR 'THE OFFICEH.s, FIREMEN, AND THEIR QUALIFICATIONS, DISCIPLINE, DRILLS, BUILDING INSPECTIONS,
REGULATION OF PU3LIC GATHKrUNGS, AND PHOVIDING FOn THE REPEAL OF ALL ORDINANCES IN CONFLICT THERENITH

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, IDAHO:
Section 1. Organization.

It shall be the duty of the City Council of the City of Rexburg to have complete supervision of the
Fire Department and require the Fire Chief to make a complete annual report concerning the department in
general, giving the description of the condition 0 f t he department, aake suggestions and recommendations
for major improvements and tell of the activities during the :,rear.
The Fire Chief shall be directly responsible to the City Council in his capacity as head of the
Fire Department.
Section 2. Fire Department.
The Fire Department shall consist of a Fire Chief and one Assistant Fire Chief and [lS many other
officers and firemen as are approved by the City Council of the City of Rexburg.
Section 3.

A. Fire Chief: The Fire Chief shall be the chief executive officer of tbe 'Fire Department~ and shall
be invested with the following authority and duties.
(1) To have direct control, management, and direction of all officers and men of the Fire
Department and the power to detail any of them to such public service as he may see fit, looking to the
best interests and efficiency of the department.
(2) 'fo carry out strictly the enforcement of the rules and regulations of the department and
be able to suspend or remove' from service any officer or fireman for cause in such manner as is provided
in these regulations.

B. The Assistant Fire Chief: The Assistant Chief shall rank next to the Fire Chief and shall have
similar qualifications. He shall take complete charge in the absence of that officer and be invested with

Section 5. Drills.

1. The department shall be drilled and maintained to the end that fires shall be controled immediately
at their start so far as possible. Drills shall be in charge of a competent officer of fireman who shall
be responsible for the proper training and dril.l1ng of men and the standardization of methods.
2. Complete drills shall be heid by each company at least twice a 'month. (Compahy drills for full
paid men,$h9Uld be h,+d at least weekly.).
Section 6. Building Inspections.
The Fire Chief or any person he may so designate is hereby authorized, empowered, and required to

2. Also, in the same districts for the purpose of ,.facilitating fire fighting, building inspections shall
be made by the department officers from time .to time but not less frequently than once every three months
to determine the arrangements of buildings lv.ith respect to one another, to familiarize themselves with
the inside of every building and its contents, to study the best methods of attacking every building in
case of fire and to note all new constructions. ,
3. Records'shall be kept of all inspections including notes and sketches.. These records. shall be
made a permanent part of t he records of the Fire Department.
4. The Fire Chief or any person he may so designate, is hereby authorized, emposered and required
to inspect buildings in vffiich public gatherings are held at the ti~e of such gatherings and to prohibit
the overcrowding of any building in which such gatherings are held and to prohibit the closing or
crowding of exits by people and the obstrut!.tion of stairvmys at such gatb.:lrings.
Section 7. Repeal of Conflicting Ordinances.
All ordinances or parts of ordinances in conflict with the provisions oJ this ordinance are hereby
repealed.
Section.a. Penalties.
1. Any person violating any of the provisions of this ordinance shall be guilty of a misdemeanor
and shall be punishable b;/ a fine of not to exceed $100.00 and upon failure to pay such fine shall be
committed to the custody of the Chief of Police and confined in the City Jail at a rate of ~1.50 per
day until the fine is paid in full.
This ordinance shall be in full force and effect from and after its passage, approval, and
publication.

For General Revenue purposes ten (10) mills on each dollar of assessed valuation.
For Streets and Alleys special fund six (6) mills on each dollar of assessed valuation.
For Municipal Health and Sanitation fund one (1) mill on each dollar of asses8ed valuation.
For City Park Fund. three (3) mills on each dollar of assessed valuation.
For Municipal Library Fund one (1) mill on each dollar of assessed valuation.
For Police Retirement Fuml one (1) mill on each dollar of assessed valuation.
For Recreation Fund one-half (.50) mill on each dollar of assessed valuation.
For Municipal Bond Interest and Sinking Fund three and one-half (3.50) mills on each dollar of
assessed valuation.
