THIS INDENTURE, made this ____ day of ________, 2023, RFW Properties, LLC, hereinafter referred to as "Grantors," in consideration of the sum of one dollar and other good and valuable
consideration, receipt of which is hereby acknowledged, herewith grant, bargain, sell and convey to the CITY OF REXBURG, a municipal corporation, of 35 North 1st East, Rexburg, County
of Madison, State of Idaho, hereinafter referred to as "Grantee,"
WITNESSETH:
That the said Grantors, for good and valuable consideration, to them in hand received by the Grantee, the receipt whereof is hereby acknowledged, do by these presents remise, release
and forever QUITCLAIM unto the said Grantee, and to their heirs and assigns forever, all the following described real estate, situated in Madison County, State of Idaho, to-wit:
A 50 FEET WIDE STRIP OF STREET RIGHT OF WAY, FURTHER DESCRIBED AS FOLLOWS:
PART OF THE NE1/4 OF SECTION 14, TOWNSHIP 6 NORTH, RANGE 39 E, B.M., MADISON COUNTY, IDAHO, FURTHER DESCRIBED AS: BEGINNING AT A POINT THAT IS S00°10’49”E, 1310.88 FEET ALONG THE SECTION
LINE FROM THE NE CORNER OF SAID SECTION 14, AND RUNNING THENCE S00°10’49”E ALONG SAID SECTION LINE 523.96 FEET; THENCE N89°56’32”W, 50.00 FEET; THENCE N00°10’49”W, 523.74 FEET; THENCE
N89°48’03”E, 50.00 FEET TO THE POINT OF BEGINNING.
TOGETHER WITH A 15 FEET WIDE PUBLIC UTILITIES EASEMENT ON THE WEST SIDE OF THE DESCRIBED RIGHT OF WAY.
Together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, and the reversion and reversions, remainder and remainders,
and rents, issues and profits thereof;
TO HAVE AND TO HOLD, all and singular, the said premises, together with the appurtenances, unto the said Grantees, and to their heirs and assigns forever.
