'-"'~~-.lb, "~LA.IIV OIO.D.IARHARD I5iTA.CO..IT.LOUla r I! !; ORDINANCE NO. 366 AN ORDINANCE ELECTING THAT THE CITY OF REXBURG COME UNDER AND COMPLY 17ITH THE PRO- VISIONS OF CHAPTER 21, TITLE 50, IDAHO CODE, RELATING TO THE CREATION AND ESTABLISHMENT OF POLICEMAN'S RETIREMENT FUND IN THE CITY TREASURY OF THE CITY OF RnBURG: PROVIDING FOR THE CREATION OF A BOARD OF TRUSTEES FOR THE POLICEMAN'S RETIREMENT FUND AND SPECIFYING ITS POWERS AND DUTIES: PROVIDING FOR A LEVY UPON ALL ASSESSED PROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY OF REXBURG IN ADDITION TO ALL OTHER LEVIES FOR RAISING FUNDS TO BE PLACED IN SAID POLICI<l[AN'S RETIREMENT FUND FOR THE PURPOSES PROVIDED IN BAlD STATE LAW ANDl,TInS ORDINANCE: PROVIDING FOR THE PAYMtJiT INTO SAID FUND OF THREE PE$ CENT PER MONTH OF THE COMPENSATION PAID TO POLICE OFFICERS OF THE CITY AND PROVIDING FOR DEDUCTING SAID AMOUNT EACH HONTH FROM THE SALARY OF SUCH POLICE OFFICER BY THE CITY TREASURER AND PLACING SA1ffi IN SAID POLICEMAN'S RETIREMENT FUND: PROVIDING FOR CARRYING OUT BY THE CITY REEBURG THE PROVISIONS AND REX2UIRZMb1ffS OF SAID STATE Ji.Tfl: REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN SO FAR AS THEY ARE IN CONFLICT WITH THIS ORDINANCE AND PROVIDING A TDAE FOR THE TAKING EFFECT OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, IDAHO: Section 1. That the City of Rexburg does hereby elect to adopt and come under the provisions of Chapter 21, Title 50, Idaho COde, relat,ing to the creation and establish- ment of a "Policeman's Retiremmt Fund" in cities, and the City of Rexburg hereby elects to adopt and carry out the provisions of said State Law in all :respects, as required of the City under the terms of said State Law. . Section 2. There is hereby created and established in the City _ Treasury of the City of Rexburg, Idaho, a fund to be known as ~oliceman' s Retire.m.ent Fund" and such fund shall continue hereafter until such fund is abolished by the Act of Legislature of the State of IdahO, if so abolis~ed. Section 3. That the City of Rexburg s'hall annually levy a tax not to exceed 1 mill on the dollar on all assessed property withih the corporate limits of the City of Rexburg, which t ax shall be levied and collected in the manner as and with the general taxes of the City and shall be in addition to all other taxes which the City is now or may hereafter be authorized to levy upon all aggregate valuation of property within the City, and the amount of such le!1 shall notrbe included within the limitation of rate of levy for general corporate~ P..U1"-p'oses, .a~~Qw or hereafter provided by law, but shall be in addition thereto. Trul the taxes so ~~ected shall be placed in the City Treasury of the City of Rexburg in said "Police~n's Retirement Fund." That the sum of three per cent per montp of the compensation paid to police officers of the City of Rexburg shall be deducted from the salary of each city police- man, beginning on the 6th day of July, 1949, and such deductions shall continue monthly as long as the said "Policeman's Retirement Fund I! exists, which said sum. so deducted shall be deducted from the salary of each police officer by the City Treasurer of the C~ty of Rexburg, and all moneys so deducted from the salary of each police officer by 1he City Treasurer and ~eceived therefrom shall be inm.ediately placed by the CitY:Treasurer in said "Policeman's Retirement Fund." Section 4. !That a Board of Trustees for the Policeman's Retirement Fund" and the administration thereof is hereoy created aftd authorized by the City of Rexburg, as provided in said State Law, and shall have and exercise the powers of such board author- ized to be exercised by such board under the provisiens of said State Law. That all of the provisions of said State Law with reference to the creation of a 'IPoliceman's Retirement Fund'," the creation and.organization of a Board of Trustees for the Police.man"s Retirement Fund, the powers and duti~s"of such board, the levying and collecting ofa tax on the assessable propeJ$y or thai/City ot Rexburg to obtain a portion ot the funds to be placed in such "Plliceman's Retirement FI1{)d," the deduction of threeiper cent from the salary of each po1ceman to be placed in such fund, the qualifications 10f a policeman to receive benefits' under said fund and. the payment of benefits to suc~ policeman of their dependents, and the time and commencement or retiremen6 of polioemen and the making of claims for benefits or p~ments thereunder, are hereby adopted as provided in said State Law. . ~ Section 6. That all ordinances or parts of ordinances in so far as they are in conflict. with this ordinance be, and the same are hereby repealed. ,.1~ l Section 7. This Ordinance shall be in full force and effect from and after its passage, approval and publication as required by law. BROWN OF REXBURG, MADISON COUNTY, IDAHO, A FRANCHISE TO USE THE PARKING METERPOLE, PIPE OR STANDARD OR ANY PART HTEREoF ON EACH AND EVERY PARKING METER WITHIN THE CITY LIMITS OF THE CITY OF BEXBURG, IDAHO, FOR THE PURPOSE OF ATTACHING THERETO A SIGN OR SIGNS, AND RESERVING THE RIGHT TO AMEND OR"REPEAL THIS ORDINANCE, FRANCHISE AND CONTRACT AT ANY TIME WITHOUT NOTICE TO THE GRANTEE.. . Be it ordained by the Mayor ana City Council of the City of Rexburg as follows: ,-) Section 1. Arvel O. Brown of Rexburg.. lladison County, Idaho, his heirs, successors or assigns, is hereby granted the sole right and franchise to use, occupy and attach to the parking meter pole, pipe or st~dard thereof on each and every parking Jaeter installed within t.he city limits of the City of Rexburg, ladison County, Idaho, a signor signs, for the period of four years from the date of this ordinance land an option for an additional two years extension as hereinafter provided under the following tetmB and on the followin; conditions. . Section 2. Section 3. Grantee herein covenants and agrees that he will attach and maintain sign spaces which will be neat, attractive, and unifonn in size, no~ exceeding three 6 x 8 inch signs pej; pole, and made of durable material and shall not contain matter, wording, or pictures which would bemorally offensive. Grantee further covenants and agrees to procure and pay for public liability insurance to protect the city and property owners from any liability for injury caused by suc~ signs. Grantee herein covenants and agrees that he will not damage the parking meter or its supporting pole in any manner and if such damage occurs then grantee at his own cost and expenses shall repair any such injured o'r damaged fixture resulting from sigh installation. Section 4. Grantee shall maintain a proper set of books correctly reflecting the current status of accounts which shall be open for inspection to and by the officials of the City of Rexburg, or its designated agents or employees. Grantee herein shall furnish a sworn statement of accounts showing the status of the business under the right and franchise herein granted, such statement to be furnished annually on or before the 30th day of January of .each year, or at such other time as such statement m.a.t be demanied by the P':oper officials of the City of Rexburg. Se Section 5. Grantee herein is hereby granted the sole right and franchise to extend the original primary term of four years for an additional two years and at the expiration of such first option period Grantee shall have the sole right and privilege to again extend this right and franchise for an additional two years if the City of Rexburg g~ants such right and franchise to any person. The Grantee shall exercise the above option by mailing to the City Council of the Ctty of Rexburg his intention to so extend said right and franchise by letter not less than thirty (30) days before the expiration of such four year period, or before the end of such first two (2) year extension. Section 6. The City of Rexburg reserves the right to amend or repeal this ordinance, franchise and contract at any time without notice to the grantee. -") ~ ----.
