ORDINANCE NO. 362
AN ORDINANCE TO AUTHERIZE, CONTROL, REGULATE AND LICENSE BUNCH BOARDS,
CHANCE SPINDLES AND CHANCE PRIZE GAMES IN THE CITY OF REXBURG, IDAH6 ;
DEFINING SUCH DEVICES, MAKING IT UNLAWFUL TO POSSESS OR PLAY OR PERMIT
TO BE PLAYED SUCH DEVISES WITHOUT A LICENSE , PROVIDING THE PENALTIES
FOR THE VIJLATION OF THE ORDINANCE, PROVIDING THE AMOUNT OF SUCH LICENSE
PROVIDING RESTRICTIONS AS TO WHO MAY PLAY THE SAME, PROVIDING THAT THE
SAME SHALL NOT CONSTITUTE A LOTTERY: PROVIDING A SAVING CLAUSE: AND
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERE~ITH:
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF REXBURG,
IDAHO:
Sec. 1. Definition of terms. (a) The term Person, when used in this ordinance
shall mean and include any person, firm or partnership, corporation, or other
associations of persons.
(b) The term "punchboard!l within the meaning of this ordinance, shall be a
board containing a number of holes of receptacales of uniform size in which are
placed slips of paper or other substance, in a capsule or otherwize, upon which
is written or printed token numbers, figures, insignia, characters, symbols,
letter or words, or combinations thereof, which may be punched or drawn from
said hole or receptacle by any person upon payment of a consideration, and who
shall obtain an award of merchandise or money only upon the chance of drawing
the token number, figure, insignia, character, symbml, letter or word, or
combination thereof, which has previously been designated to pay a prize.
(C) The term "chance spIndle" within the meaning of this ordinance,shall
be any spindle , stick, pin, or other device on which may be fastened by any method
slips of paper, envelopes, cards, or other devices, upon which is written or
printed token numbers, figures, insignia, characters, symbols, letters or words,

shall be any game in which the obtaining of a prize is based soley upon the chance
of the player, upon the payment of a consideration, to draw or otherwise secure

Sec. 2. That punchboards, chance spindles and chance prize games are hereby
autherized to be operated or played within the City of Rexburg, Idaho, upon the

procurement by the owner thereof of a license, as hereinafter provided.
Sec. 3. That such license fees are hereby fixed as !ollows on all devices
where the prize is money or merchandise redeemable in money:
Four per cent (4%) of the amount computed by
multiplying the number of chances on such de-
vices by the price charged per chance.
Sec. 4. That such license !ees are hereby fixed as follows on all devices
where the prize is merchandise not redeemable in money:
Two per cent (2%) of the amount computed by
multiplying the number of chances on such

Sec. 5. It shall be unlawful for any person to have in his possession for the
purrose of having operated, played or used on said person's premises, or in con-
nection with said person's business, any punchboard, chance spindle, or chance prize
game without having first obtained ~rom the City Clerk of the City of Rexburg,

his deputy; that nothing herein contained shall be construed to prevent the
issuance of such license by a deputy in the office of such City Clerk.
Sec. 6. It shall be unlawful for any person to whom such license is issued

to permit any person under the age of 21 yeas to play any such devices, andit
shall be unlawful for any person under the age of 21 years to play any such
devices.
be guilty of a misdemeanor and shall be punishable by a fine of not to exceed
$100.00, and upon failure to pay such fine shall be committed to the custody
of the Chief of Police and confined in the City Jail at the rate of $1.50 per
day until such fine is paid in full.
Sec. 8. If any portion of t is ordinance shall be declared invalid, it shall
not affect the validity of the remainder thereof.

Sec. 9. All ordinances or parts of ordinances insofar as they are in con-

Sec. 10. This ordinance shall be in force and affect f~ and after its pass-
age and approval and publication.
