QRDINANCE NO. 348
AN ORDINAlUlCE RELATING TO AND PROHIBITING THE DEPOSITING
OR PLACING, OF ANY OFFAL, GARBAGE OR OTHER WASTE MATTER
OR DEBTIS IN OR UPON THE STREETS OR PUBLIC ALLEYS OF THE
CITY OF REXBURG, IDAHO, OR PILING OR DEPOSITING IN OR UPON THE
THE STREETS OR PUBLIC ALLEYS OF SAID CITY ANDY EARTH, SAND,
GRA VEL OR OTHER MA TERIALS EXCEPT WHEN AUTHORIZED BY A PER-
MIT, DECLARING &NY SUCH THINGS TO BE PUBLIC NUSIANCE AND
PROVIDING A PENALTY FOR VIOLATION HEREOF.

Section 1. It shall be un1a.~ for any person, orasssociation of persons or any company or
corppration to pile, place ot deposit in or upol) any street or public ,alley of the L;ity of RexbD.ri,
Idaho, any offal, garbage, rubbish, trash, ~lass, bones, ashes. cinders or other refuse,OIbris or

waste matter or material of any Id.nd; or to pile, pla~e or deposit in or upon any street .r public alley
of saia city any earth, sand or gravel, or any stone, brick, blocks, lumber or other materials axpect
for inmediate use in the leveling, grading or otherwise improving such streets or alleys, or in the con-

struction of a building or buildings, on land inmediately eontiguous to the street er alley where same

is p~~ed, and in such cases only after a ~ nnit so to do shall have been obtained from the Chief of
P.lice of said city.
Section 2. Any offal, garbage, ruBBish, trash, glass, bones, ashes, cinders or any refuse, de-
bris or waste matter or material 0 any kind piled, placed or deposited in or upon any street or public
alley of said Cityed permitted to remain therein or thereon for more than twenty-four nous~shall be
deemed, and is hereby declared to be a public nuisance; and any person or association of persons, or
any comp;il.ll1' of corporation who shall pile, place or deposit, or cause or directs to be piled, placed
or deposited in or upon any street or plblic alley of said city any of the matter, substance, things
or materials l1entiened in thj.s ordinance and fijlall allow same to remain in or upon sicp. street or alley
in violation of the provisions of this, ordinance shall be guilty of a misdemeanor, and apon conviction
there.f shall be punished by fine of not less than $5.00 and not more than $100.00 and the cost of
the prosecution, aad in default of the payment of such fine and costs, or either, shall be confined t..n
the city jail and put to work for the benefit of the city, at the rate of $2.00 per daY' for each day
he shall worJ, until such fine ane costs are paid.
