':mEHEAS: cl'he city council of the ci ty of Rexburg, on the 20th day of Novwmber, A.D., 1929, duly passed a resolution declaring it to be the intention of the mayor and council of said city to create and eEtablish a local im.Hovement district in said ci ty to be called Local Imppovement ))istriet if)ewer{inuIilb~rt.h!ee, and declaring their intention to make the improvement proposed therein, and directiong that public notice be given of ghe time within which protests against said proposed improvement and the creation of said district might be filed, and fixing Wednesday, the 4th day of December, 1929, as the time ru1en such protests would be heard and conGid.ered by the council, and notice thereof having been given and no protest having been filed: Be It Ordained, By the mayor and council of the ci ty of Rexburg, Idaho: Section 1.- That a public i"":'lprovement namely, 350 feet pf sewer line, 8 inches in diameter, with all necessary ays', and manholes and necessary parts and I'PllUrtenances, to serve all dwelling houses and other buiilidings within the district hereinafter described and conneetions with the main sewer line of the city's sewer system~ be installed and laid at ,nd bet ween the following points namely: Commencing a~ the main sewer line 166t feet no~th and 185 feet east of the Southwest corner of Lot 3, Block 31, Rexburg ~ownsi te, and extending thence, north in a straight line 350 feet. ~ection 2.- That there be"and is hereby created and esta blished a local improvement ciistr!ct called. Local Improvement Sewer :li>istrict Number Three, for the making, laying and installing of a sewer line as defined. and pirovided foe in Bection 1, of this ordinance, and that said lical improve~ent district shall include all the property embraced therein, and lis and shall be bounded and described as follows, to wi t; Beginning~t the lioethwest corner of ~ot 2, flock 31, of Rexburg ~ownsite.:(City of Rexburg),and running thence south 20 1'ods; thence fl8sthlOnr.'pde ; thence north 10 rodf$; thence east 18 rods; thence north 10 rOde;.the ce west 28 rods; to;;"'4e point of beginning, and embracing a part ot Lo 1 and and a part o~tot 2 of said Block 31. Section 0.- ihat it is hereby male the duty of the committee on1streets together with the city engineet of said city to make out an asses merit.:~oll according t<> the provisions of this ordinance, which assess ent roll shall contain among other things the number of the assessment, he name of the owner of each lot or paro6i~~f land, if known and if not k own that the owner is Unknown, a description of ..ch tract of land asse sed and the total amount of the assessment charged thereto; and to ce tify said assessment roll to the city council of said city, and upon the coming in of such assessment roll the council shall fix a tome when obJections thereto, by the property owners in said district, will be heard, and Cause such assessment rill to be filed in the office of the city .lerk; and that the City clerk upon receiving said assessment roll .ha~. g~ve notice by publication in the official newspaper of said city in one ,eekly issue thereof, that such assessment roll is on file in his office and the date of fi ling the same, and said DO.ice shall state the time at whic~ the council will hear and consider objections to said assessment roll by parties aggrieved by such assessmentefl which said ti'Yle shall be not less than ten days feom the ,lUblica tion herein provided for, and all ofjections to said assessment shalll be in writing.
