That this ordinance, being fwr the purpose of providing funds for the immediate payment of the balance of the costs and expenses of improvement in said Local Sewerage Improvement District No.1, the same shall therefore be in full force and effect from and after its passage, approval, and due publication, according to la w . BE IT ORDAINED BY THE fil.YOrt AND THE CITY COUNCIL OF THE CITY OF REXBURG, MAD- ISON, IDAHO: Section 1. That the sala.ry of the City Treasurer is hereby fixed at the rate ~ of Three Hundred (~300.00) Dollars per annum, to be paid quarterly at the end of each quarter as the shall become due. Section 2. That the ordinance or parts of ordinance in conflict there',vith are hereby repealed. Sec~ion 3. That this ordinance shall take effect May 1, 1921. PASSED and APPROVED this 6th day of April, 1921. AN iORDINANCE REGULATING STREET EXCAVATIONS IN THE CITY OF REXBURG, COUNTY OF MADISON; IDA~O, ESTABLISHING A SYSTEM OF SUPERVISION THEREOF AND DECLARING AN EMERGENCY THEREFOR. ,:':,,0 WHEREAS, The City of Rexburg has constructed a sewerage system within certain }...... . '~~~ district. of the City and a water system in certain parts o~ the City, and WHEREAS, It is necessary to connect private property with said sewerage sys- tern, and WHEREAS, In making such connections it 1s found necessary at times to make excavations in streets of said City, NOW THEREFORE, BE IT ORDAINED, by the Mayor and City Council of the City of Rexburg, Madison County, state of Idaho: Section 1. It shall be unlawful for any person, persons, firm or corpora- - - - - -] ---.,/ - '__4~___a~, .. Section 2. No permit for any street excavation shall be issued until written application therefor has been made to the City Engineer, signed by the party making tho has filed with the City Clerk a bond of indemnity to the City, ed by the City Counc~ _, conditioned that the pe rson making the excavation will erect and maintain about said excavation and until the street is restored to its normal con- dition, sufficient guar.ds, signals, barricades and lights, to prevent an accident, and () will, as soon as may be after the completion of s~id works, restore said street to the same condition in vrhich it existed prior to said excavation and will remove rocles, dirt " -~, and rubbish from the street and will save the City harmless from any and all claims, liabilities, demands or damages for any and all injuries to person or property arising in any manner out of, or by reason of any such e~cavation. Such bond shall be in the c sum of $5,000.00 for excavations in all streets, rROVIDED, HO'.~1EVER, that wherever pavinb or macadam, dirt or rock is removed in the process of any street excavation, such paving Or macadam, dirt or rock, must be replaced under the direction and to the satisfaction of the City Engineer and at the expense of the party making the excavation, PROVIDED FURTHER, that in excavating through asphalt or cement the excava- tion shall be cut perpendicularly at the side and ends from the surface, the full length and width of all excavations to the necessary depth.
