AN ORDINANCE DECLARIlTG 'l'HF IN'l'ENTION OF THE CITY COUNCIL OF THE CITY OF
REXBURG, MADISON COUNTY, IDAHO, TO CREATE AND ESTABLISH A LOCAL SEWERAGE IMPROVEMENT
DISTRICT:

ORDERING THE PUBLICATION OF THE ORDINANCE.
WHEREAS; It is deemed necessary for the comfort, convenience, health and
wellbeing of the inhabitants of the City of Rexburg, Madison County, Ptate of Idaho,
for the City Council of the said City to construct, build, keep, conduct and maintain
a lateral sewerage system in a certain local sewerage improvement district hereinafter
described.
AND WHEREAS; the costs of said sewerage improvments, if said district
shall be hereafter created, will be levied and assessed upon all the property benefited,
to -wi t:
Upon the lots and pare 01 s of land fro nti ng on a ny highway, s tree tor alley
that may be included within said district, as well as on all the lots or parcels of
land situated therein except as hereinafter provided.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG,
MADISON COUNTY, IDAHO:
Sec. 1.
That it is the intention of the City Council of the City of
Rexburg, Idaho, to croate and establish a local sewerage improvement district including
all the property fronting on the highways, streets or alleys and all the lots and parcels
of land included within the boundary lines of E&id local sewerage improyement district
as hereinafter designated by the Oity CounCil, other than that portion occupied by
highways, streest and alleys.
Sec. 2.
That it is the intention of tlle Cit;,' Council to fix the follow-
ing boundary lines for the said local sewerage improvement district, to-wit:
Commencing 100 feet East of the northwest corner of Block V, of the
Rigby Addition to the City of Rexburg, Madison County, Idaho; thence south 1419 feet
along a line 100 feet east of the east side of Third East Street to the south bcundary
Of Block 10 of the Rigby Addition; thence west 1518 feet to a point 100 feet east
of the southwest corner of Block 4 of the Parker Addition; thence south 759 feet to
4th South Street; thence west 299 feet to a point 100 feet west of the southeE:.st corner
of Block 6 of the Parker Addition to the City of Rexburg; thence north 1089 feet to the
north line of Lot. 5, Block ~ of the Parker Addition; this being tho boundary line of

Section III.
That it is the intention of the City Council of S Aid City

to construct in said district a gravity sewerage system that will efficienti y sewer
and drain the sewerage of the property of SAid district, including the cellars and base-
ment s on such prope rty, through conduits or pip os of cement or vi trif i cd c18.7 cement ed
together and laid in trenchos beneath the ea.rth's surface, to and into the sewerage
system now being constructed in Local Sewerage Improvement District Bo. 1 of said \iity

and to establish house connections; the estimate cost of which will mOre fully appear
in the esticate now on file in tho office of the City Clerk of the City of Rexburg,
together with the plcJns, outlinos and specifica.tions, which persons interested are
referred to for more detailed information.
Sec. IV.
That the costs of said improvements, if rw de is estimated at
Sixty Thousand $60,000.00) Dollars or approximately $:='.25 per front foot on all property
where single line of sewer serves both sides of street or alley and $4.25 por front
foot where single line of sewer serves only one side of street or alley and is tn be
assessed against all of the property included in the said sewer district in proportion
to the benefits derived, provided however that all costs and expenses of the sewerage
improvements made in the spaces formed by the conjunction or intersection of streets
and avenues and in the spaces opposite alleys in the distr_ct ordered to be improved,
shall be borne by the property abutting upon, contiguous or contributary to said inter-

section, and shall be a lien upon saig. pr',::perty the same as any other as:;essment against
said property in said district.
Sec. V.
That the said work if the same shall be done, be in accordance
with the plans and specifications prepared by HUddleson and Fiero of Salt Lake City,Ut~h
associated with C.A. Sundberg of Rexburg, Idaho, which plans and spccifica.tions remain
on file in the office of the City Clerk and are hereby referred to for greater certain-
ty as to the particular method to be adopted for the improvement of said streets.
Sec. VI.
That the intentjon of sllid City Council to create said district
is hereby expressed and if the same shall hereafter be created and contracts let for
the performnnce of the work, the said City Council may insert a clause in,the ordinance
creating said district that such reasonable cherge as the seid City shall designate as
for overhead expense, including engineering services, publication of resolutions,
ordinances and notioes, clerical and legal services, shall be included in and charged
as a part of the cost of said improvememts.
SEC VII.
That March ~Oth to April 8th, 1920, inclusive, at the hour of
8 o'clock PM in the City Hall of sfl.id City o:f Rexburg, Idaho, be, and the same is hereby
fixed as the time and place at which protests against said proposed improvements IDa7
be filed in the office of the City Clerk of said City.
Sec.VIII.
That on said 8th day of April, 1920, at said hour of eight 0'
clock P.M., the City Council of said City shall convene in special session for the
purpose of hearing and oonsidering any such protests as may be filed and take such
action as may be deemed advisable relative to the creation of said improvement district.

That the City Clerk be, and he is hereby orderod to cause pub-
lication of this ordin~nce to be made in the Rexburg Journal, the official newspaper
Of said City, in at least two consecutive issues thereof before the time fixed in this
ordinance for the filing of such protes-ts, am. that the affidavit of such publication
shall be on file on or before the time fixed for the filing of such protests.

Sec. X.
That whereas, an emergency is hereby end herewith declared to
exist, this ordinance shall therefore take effect and be in force from and after its
passage, approval and due publication.
