The property apparently was owned by Alexander and Freda Christensen Weber who died in 1971 and
1980 respectively. Their heirs probably continued to farm the property, perhaps with son-in-law Jessie
Norman Kington in charge. Then, in 1997, the heirs sold the property.
7 Oct 1997 – The four daughters of Alex and Freda Weber sold the property to Taylor Property Limited
Partnership. (Deed 268567)
12 Nov 1999 - Dean Shumway Birch, husband of Delores Jones Birch, died in Mexico.

16 July 2002 – The Estate of Dean S. Birch, and Deloris Birch conveyed the property to Birch Properties

2 Apr 2003 – Rexburg annexed county agricultural properties into the city, including Parcel
RPRXBCA0254499. Annexation included designating the country neighborhood along South 12th West as

5 Sep 2007 – Birch Properties LLC conveyed the horse pasture to Triad-Birch LLC (Deed 340398)
6 Dec 2007 – Triad Development Group LLC petitioned the City of Rexburg to change the city’s
Comprehensive Plan Map for the country neighborhood that included the horse pasture, from Low-
Moderate Residential to Moderate-High Residential Density, which would then allow zoning to be
changed to more crowded residential zones in that country neighborhood, including more concentrated
dwellings put next to Highway 20. The petition was DENIED.
5 Oct 2009 - Triad-Birch LLC conveyed the horse pasture back to Birch Properties LLC. (Deed 356907)
17 Mar 2010 – Jon Gregory (#09 00470) petitioned the City of Rexburg to change the city’s
Comprehensive Plan Map for just the 25-acre horse pasture from Low Density Residential to Medium
Density Residential. The city Planning and Zoning Commission was neutral about the “land use
designation” change, however the City Council DENIED the change.
1 April 2021 – Brent Anderson (#21-00079) petitioned the City of Rexburg to change the zoning on the
25.5-acre horse pasture from Rural Residential 2 (RR2) to Low-Density Residential 2 (LDR2) and to
Medium-Density Residential 1 (MDR1) along Highway 20. The city Planning and Zoning Commission had
recommended denial of the change. The City Council also DENIED the request for rezoning.
24 June 2021 – Birch Family (#21-00310) again petitioned the City of Rexburg to change the zoning on
the 25.5-acre horse pasture from Rural Residential 2 (RR2) to Low-Density Residential 1 (LDR1), Low-
Density Residential 2 (LDR2) and Low-Density Residential 3 (LDR3). Brent Anderson said he had met with
the mayor and P&Z to come up with the proposal. Staff recommended approval. Birch Family agreed to
move or pipe the canal along 12th West Street! The P&Z commission voted to approve the rezoning. Only
Greg Blacker voted against rezoning.
7 July 2021 – City Council met to consider P&Z’s recommendation to approve rezoning (#21-00310) of
the horse pasture. Staff member, Alan Parkinson, said “it was the right thing to do.” The mayor spoke in
favor of rezoning. Tisha Flora made a long presentation with slide show to justify her reluctant vote
approve rezoning. Chris Mann voted in favor of rezoning. Jorden Busby, Michael Walker and Bryanna
Johnson voted against rezoning. By a margin of 3 to 2, the City Council DENIED the request for rezoning.
15 February 2022 – The 25.5 acre horse pasture was listed for sale on Realtor.com for $1,150,000.
Property Details Given: "25.5 acres located between US Highway 20 & 12th West in City of Rexburg
Idaho. Current use is as a horse pasture. Current zoning (Rural Residential 2) allows SFR on .5 acre lots.
This acreage is within walking distance to Burton Elementary school and Madison High School. There
appears to be a City water main and City sewer on 12th West." Four days later the listing was removed.
6 April 2022 - Joe Allen, Realtor for Century 21 High Desert (208 351-1047 - mobile), responded by
email, "i have an accepted offer on that 25 acres."
17 October 2022 – Madison County Parcel Report shows no new deed conveying the 25.5 acre Parcel
Number RPRXBCA0254499 to anyone else. Birch Properties LLC still owns it.
October 25, 2022 – The Rexburg Standard Journal published notice of a public hearing to be held on
November 17, 2022, at 6:30 PM before the Rexburg Planning and Zoning Commission (#22 00733) to
amend the zoning map for the city of Rexburg to rezone Parcel No. RPRXBCA0254499 from Rural
Residential 2 (RR2) to Low-Density Residential 1 (LDR1) and Low-Density Residential 2 (LDR2).
