August 2, 2022, An application was received for a Rezone from Public Facilities (PF) to Medium-Density Residential 1(MDR1) from Bron Leatham. 2. August 3, 2022, Fees were paid. 3. August 4, 2022, Staff Reviews were completed. 4. August 5, 2022, Notice was sent to the newspaper to be published on August 16th and August 23rd, 2022. 5. August 8, 2022, Notice was mailed to all property owners within 350’. 6. August 24, 2022, Notice was posted on the property. 7. September 1, 2022, Kyle Baldwin presented the application to the Planning & Zoning Commission. (22-00564) – 297 E 7th N – Rezone from Public Facilities (PF) to Medium-Density Residential 1 (MDR1). The Comprehensive Plan Map designates this parcel as MDR1-HDR2. The parcel for this request is 0.2 acres. – Bron Leatham (action) (0:53:55) Applicant Presentation: Bron Leatham – (Absent) Commissioner Questions: None Staff Report: Kyle Baldwin – This is a rezone application for a parcel zoned as Public Facilities (PF). The parcel has been purchased from the city and the applicant is seeking for it to be rezoned to match the adjacent Medium-Density Residential 1 (MDR1) parcel to the east. The applicant has met the requirements of the application. The parcel is currently serviced by city services. Commissioner Questions: Vince asked when the city purchased the property. Kyle said the property was zoned in 2019 as Public Facilities (PF), so the city owned the property at that time. The property is no longer needed by the city. Is the intention of the applicant to combine this parcel with the land to the east? Kyle said he does not know what the applicant’s intentions are. Alan said the property to the north and the east of this application is owned by Bron. The piece has been purchased to join with the adjacent property. Vince said Bron is listed on the state’s website for the property adjacent’s LLC. Chairperson Smith opened the public input portion of the hearing at 7:28PM. September 7, 2022, Kyle Baldwin presented the application to City Council. Planning & Zoning recommendation to approve a rezone at approximately 297 E 7th N from Public Facilities (PF) to Medium Density Residential 1 (MDR1) zone #22-00564. Designated as Ordinance No 1290 if motion passes – Alan Parkinson City Planner Baldwin reviewed the map of the proposed rezone property. In 2019, there was a citywide effort to designate city-owned, county-owned and school district-owned properties within the city limits. Bron Leatham has purchased this property from the city and is requesting the zone match the zone to the north of the property. City Attorney Zollinger clarified this was a piece of 3 | Page property the city purchased for the Water Department. There were concerns with this property having its own septic tank and its own well directly adjacent to a city well. The Water Department has no use for this property. The city sold the property to a private investor. For this reason, city staff is recommending the property no longer be zoned Public Facilities. Council Member Flora moved to approve the Rezone at approximately 297 E 7th N from Public Facilities (PF) to Medium Density Residential 1 (MDR1) zone Resolution 2022 – 22 Amend and Restate the City of Rexburg Salary Reduction Plan; Council President Busby seconded the motion; Mayor Merrill asked for a vote: Those voting aye Those voting nay Council Member Flora None Council Member Johnson Council Member Chambers Council Member Walker Council President Busby The motion carried. 9. September 21, 2022, City Council considered the application for a 2nd Read. Ordinance No 1290 Rezone 297 E 7th N from Public Facilities (PF) to Medium Density Residential 1 (MDR1) Zone #22-00564 4 | Page Council Member Walker moved to approve Ordinance No 1290 Rezone 297 E 7th N from Public Facilities (PF) to Medium Density Residential 1 (MDR1) Zone #22-00564 and consider it second read; Council Member Chambers seconded the motion; Council Member Busby asked for a vote: Those voting aye Those voting nay Council Member Chambers None Council Member Johnson Council Member Walker Council President Busby The motion carried. 10. October 5, 2022, City Council considered the item for a 3rd read.
