HomeMy WebLinkAboutPost Hearing - Peter Williams Hidden Valley Letter to City CouncilFrom 71 Households in Hidden Valley Subdivision September 5, 2022 Re: RPRXBCA0291271 (south of Star View Drive) - Rezone from Low-Density Residential 1 (LDR1) to Low-Density Residential 2 (LDR2) Dear Mr. Mayor and City Council Members, We are writing to reiterate our opposition to this rezone request. We are concerned that the change will fundamentally change the nature of our community. However, if the rezone is inevitable, we request a compromise to the developer ’s current rezoning request. We understand that the developer would like greater density to offset development costs. However, the community would like to preserve the character of the community with single family detached residences. One purpose of zoning is to preserve the "character" of a community. High density housing will change the character of the existing Hidden Valley Subdivision as well as the existing community on Mill Hollow as well as future envisioned communities further up the hill. We submit the following compromise to the proposed request to rezone the property south of Hidden Valley from LDR1 to LDR2. Even though the existing Hidden Valley Subdivision is currently zoned LDR2, some of the rights associated with the LDR2 zone have been limited by covenant. The following covenants taken from the "Declaration of Covenants of Hidden Valley Subdivision, LLC Phases 7, 8, and 9" limit the rights of the LDR2 zone: ●"Lots shall be used for single family residences." Twin homes and duplexes that are permitted by the LDR2 zone, by covenant, are not permitted in the existing Hidden Valley Subdivision. ●"Mobile homes, manufactured housing, and modular homes are specifically not permitted." The aforementioned structures, by covenant, are not permitted in the existing Hidden Valley Subdivision. If City Council must grant the rezoning, we propose the city and developer enter into a development agreement stipulating that "all lots shall be for single family residences," and that "mobile homes, manufactured housing, and modular homes are specifically not permitted." This allows the developer to go from 12,000 sf per lot to 8,000 sf per lot. As such, the developer gets greater density and the community gets single family detached residences. Thank you for your service and careful consideration. This letter was collaboratively drafted and distributed through our Home Owners Association email list, texts, and physical copies around the neighborhood. Residents were given an opportunity to sign a physical copy or add their name and address below if they were unable to get to one of the hard copies in time.
