We, DROC Holdings LLC, own the property as described below:
Situated in the State of Idaho, County of Madison, being part of Lots 2 and 3, Block 24, Rexburg
Townsite, Section 19, Township 6 North, Range 40 East, of B. M., being more particularly
described as follows:
Commencing at the Southwest corner of said Lot 3; thence North 0015'02" West, a distance of 3
5.5 1 feet to a rebar with a plastic cap set stamped, "PLS 13856" marking the point of beginning;
thence North 001602" West, a distance of 299.46 feet to a point; thence North 89024'54" East,
a distance of 176.12 feet to a point on the West right of way of the Eastern Idaho Railroad;
thence South 3000722" West, a distance of 350.29 feet with the West right of way of said
Eastern Idaho Railroad to the point of beginning.

It is our understanding that this property will be included in Local Improvement District (L.I.D.) Number
51 for the City of Rexburg. We understand that the hearings have already been held on this project and
that by executing this document, we hereby waive our rights to the hearings and waive our objections to
be included in this Local Improvement District.
We understand by signing this waiver, that any and all costs, including, but not limited to, construction
costs, interim interest, hookup fees, front footage fees and meter costs, paid by the City of Rexburg in our
behalf shall be placed as a lien on our above described property as a part of L.I.D. 51.

Townsite of Rexburg, Madison County, Idaho, and running thence East 140 feet to the Westerly
Right of Way line of the Eastern Idaho Railroad; thence South 30degrees2l'14" West 300 feet
along the Westerly railroad Right of Way line; thence West 140 feet; thence North 30021'14"
East 300 feet to the point of beginning.
