Addendum for Septic System that 9panr Multiple Parcels This permit is being rssued with the understandint that the Bub$urface sewage disposal system will be installed on a combination of two or more properties/parcels. lf these properties have different owners, or a sale of one of the properties occurs after the permit is irsued such that ownership of one of the properties transfurs to a new individua/entity, it is the responsibility of the system owner to secure a valkl legal agreement (e-g-, an easementl between all properties involved. This atreernent mugt ensure accesr to the entire system indefinitely and convey through transfer of property ownership unless the sy:tem is abandoned, remorred. replaced, or the p€rmit is renewed, lt rs not the duty of the health dittnct to determine the legal adequacl of the agreement, and the irsuance of a permit does not in any way reprerent or wilrrant that access has been properly created. lf for any rearon access to any portioo of the subsurlace sewage disposal system is b't and the system can longer receive blackwaste and wastewater, the system may be considered a failing system pucuant to ADAPA 58.01.03.003.13. The owner of the waste-generatln8 property must establtsh a new easement orother legal agreement that grants access to the property where the wastewater is treat€d. stored or disposed of. lf no le3al access aSreement can be reached, the owner ofthe waste-generatint property must obtain a permit to repair or replace the failing system (IDAPA 58.01.03.0O4.05). ln the event the failing system cannot be repaired or replaced in a way that meets the currmt rules and regulations, the health district may irsue a nonconforming permit if it can be determined that the public's health is not at risk (IDAPA 58.01.03.m8.U).
