AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be
granted as requested, that it be modified, or that it be denied.”
I. BACKGROUND
The property contains a single mobile-home. In 2019, this
parcel was rezoned Public Facilities (PF) as part of a citywide
effort to designate city-owned, county-owned, and school-
district-owned properties within city limits (19-00093).
The Rexburg Development Code allows the Commission to
make recommendations to the City Council regarding whether
or not the property should or should not be rezoned based on
the criteria found in section §1.04.020.
II. SITE DESCRIPTION
The property is located to the east of one of the city’s water
towers and north of the Teton River Lofts development. The
property is 0.2 acres.
III. ANALYSIS

The Comprehensive Plan designation surrounding this property is MDR1-HDR2.

Surrounding Zoning
Medium-Density Residential 1 (MDR1) is zoned to the north
and east, Medium-Density Residential 2 (MDR2) is zoned to the
south, and Public Facilities (PF) is zoned to the west.
If approved, the request will result in changing the zoning of the
parcel at 297 E 7th N from Public Facilities (PF) to Medium-
Density Residential 1 (MDR1) for 0.2 acres.
The request would require the Commission and City Council to
review the proposal against one set of criteria, for the request to
rezone. Below, staff has provided all the criteria listed by
Ordinance No. 1200 (Development Code) that are required to
be addressed, followed by staff’s analysis of each criterion.
Criteria Rezone Requests (§1.04.020):
a. Be in conformance with the City’s Comprehensive Plan.
The request is in conformance with the Comprehensive Plan Map.
b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities,
solid waste collection and disposal, and other utilities.
The lot already has services. Storm drainage will have to be handled on site.
c. The capacity of existing public services, including but not limited to, public safety
services, public emergency services, schools, and parks and recreational services. N/A
d. The potential for nuisances or health and safety hazards that may adversely affect
adjoining properties. N/A
e. Recent changes in land use on adjoining properties or in the neighborhood of the map
revision.
Kenneth Square was platted in 2017 with Ella Lane (17-00226). Most of the buildings have been
completed. Centennial Townhomes subdivision was platted in 2019 (19-00100). In 2020, a plat was
submitted for Covey Cove on the lot adjacent to the east of this request (20-00448), but the applicant
never addressed county surveyor requested revisions and the permit expired. Yellowstone Heights
Condos Plat was approved April 20, 2022, but the plat still needs to be signed and recorded with
Madison County (20-00899). In 2021, Stonebridge Townhomes requested a rezone from LDR2 to
MDR1, which was denied (21-00063). A second request was made to rezone from LDR2 to LDR3
and it was approved (21-00377). (21-00056) A plat application was submitted without all of the
required documents and it did not progress. Teton River Lofts has submitted a Plat for Phase 1 (22-
00413).

IV. STAFF RECOMMENDATION
Staff requests that Planning and Zoning recommend to City Council to approve the rezone of 297 E 7th N
from Public Facilities (PF) to Medium-Density Residential 1 (MDR1), if the Commission finds that the
proposed request is compatible with the surrounding area or in the best interest of the neighborhood and the
community.
