MUIR Fee: 0.00 Q Ex-Ofticio Recorder DepiAY �/ C IT Y OF REXBURG America's Family Community ORDINANCE NO 1287 Rezone Approximately 2332 West 2000 South, Rexburg, Idaho to Low Density Residential (LDR3) AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG, IDAHO, AND PROVIDING THAT THE ZONED DESIGNATION OF THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED, SITUATED IN REXBURG, MADISON COUNTY, IDAHO, BE CHANGED AS HEREINAFTER DESIGNATED; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY the City of Rexburg, Idaho: SECTION I: That the zoning map of the City of Rexburg, Idaho, which is filed with the city clerk thereof, be, and the same is hereby amended and changed to provide that the hereinafter described property situated in the City of Rexburg, Madison County, State of Idaho, regarding (#22 00258) to adjust the Community Business Center (CBC) zone and rezone from the Low Density Residential 2 (LDR2), Medium Density Residential 2 (MDR2), and Community Business Center (CBC) zones to Low Density Residential 3 (LDR3) zone in the City of Rexburg, Madison County, Idaho. The said property is located at approximately 2332 West 2000 South in Rexburg, Madison County, Idaho, and more particularly described as follows: Legal description of each zone: Situated in the State of Idaho, County of Madison, City of Rexburg, being part of SE 1 /4, Section 35, TWP. 6 N, Range 39 E, B.M., being more particularly described as follows: commencing at a brass cap marking the southeast corner of said Section 35; thence south 89°56'19" west, a distance of 685.38 feet to a rebar with a plastic cap set, stamped "PLS 13856", marking the point of beginning; thence south 89°56'19" west, a distance of 643.80 feet to a pk nail found; thence north 00'00'11" west, a distance of 460.00 feet to a rebar with a plastic cap set, stamped "PLS 13856"; thence south 89°56'19" west, a distance of 68.00 feet to a rebar with a plastic cap set, stamped "PLS 13856"; thence north 00'00'11" west, a distance of 848.08 feet to a rebar with a plastic cap set, stamped "PLS 13856"; thence north 89°55'58" east, a distance of 71 1.80 feet to a rebar with a plastic cap found; thence south 00'00'11 " east, a distance of 1,308.15 feet to the point of beginning. Containing 20.66 acres of land, more or less. SECTION II: That a new zoning map showing these amendments shall be certified to and declared to be the official zoning map of the City of Rexburg by passage of this Ordinance by the City Council of the City of Rexburg. SECTION III: This ordinance shall become effective upon its passage, approval and publication.
