HomeMy WebLinkAboutWRITTEN RESPONSE - Hearing #2 - Farnsworth - 22-00072 - 1 parcel Muir Glen DIV1 - RP04MG1001004D - Impact Area - Rezone from TAG to MDR1Mark Farnsworth 278 West Moody Road Rexburg, Idaho 83440 20 July 2022 Dear Rexburg Planning and Zoning Commission, From my perspective, nothing has changed regarding the zoning of parcel number RP04MG1001004D since the last time the proposal to rezone was rightly rejected. At that time, I spoke in opposition to the rezoning, and my wife and I presented a petition signed by homeowners and property owners along West Moody Road. Every person to whom we spoke signed in opposition to the rezoning. We have now gathered additional signatures, and the feedback remains unanimously opposed to the rezoning. Rezoning this land would be detrimental to the wishes and best interests of current residents, and they have made their voices heard to this effect. Another reason to reject the rezoning is that changing the zoning of this one lot would qualify as spot zoning. This concern rightly emerged in the previous meeting, and as of 19 July 2022 all surrounding land remains zoned for transitional agriculture. Merriam-webster.com gives this definition of spot zoning: “The rezoning of a small parcel of land within the limits of another zone that is illegal when not done in accord with a comprehensive zoning plan or when arbitrary or discriminatory.” This rezoning would be done within the limits of another zone, would arbitrarily benefit a single property owner, and would discriminate against the desires of surrounding landowners as presented in the submitted petition, in the previous meeting on this subject, and presumably in the meeting that will be held on 21 July 2022. I recognize other valid concerns exist regarding the rezoning of this land, but to me the most pressing is that rezoning it would arbitrarily and discriminatorily infringe on the rights and wishes of current residents. I urge the council to represent their constituents and oppose this rezoning. Sincerely, Mark Farnsworth
