ORDINANCE NO.1282
AN ORDINANCE ANNEXING CERTAIN LANDS TO THE
CITY OF REXBURG, IDAHO; DESCRIBING SAID LANDS
AND DECLARING SAME A PART OF THE CITY OF
REXBURG, IDAHO; AND AMENDING AND CHANGING
THE ZONING MAP OF THE CITY OF REXBURG, IDAHO,
AND THE CLASSIFICATION OF THE SAME UNDER THE
ZONING ORDINANCE OF THE CITY OF REXBURG,
IDAHO; AND PROVIDING WHEN THIS ORDINANCE
SHALL BECOME EFFECTIVE.
WHEREAS, the lands hereinafter described are contiguous and adjacent to the City of
Rexburg, Idaho, and have been laid off, subdivided or platted, and/or the City has been
requested to annex the same to the City of Rexburg, Idaho; and
WHEREAS, it appears to the Mayor and City Council of the City of Rexburg, Idaho, that
the hereinafter described properties is subject to annexation to the City of Rexburg under
and pursuant to the provisions of Section 50-222 - Category A, Idaho Code, and that said
lands should be annexed to and become a part of the City of Rexburg, Idaho; and
WHEREAS, the City Council referred the zoning of the affected territory for report and
recommendations to the Planning and Zoning Commission, and the Planning and Zoning
Commission made its report and recommendations for zoning classification of the
hereinafter described properties proposed to be annexed; and
WHEREAS, the Council has determined that the proper classification under the Zoning
Ordinance of the City of Rexburg, Idaho, for the properties to be annexed is as hereinafter
set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF REXBURG, AS FOLLOWS:
The property located at approximately 1174 N Yellowstone Hwy, Parcel RP06N40E174346
in the Community Business Center (CBC) zone in the Impact Area for the City of Rexburg.
This property is hereby annexed to the City of Rexburg and are hereby declared to be a part
of the City of Rexburg, Idaho (#22 00182).
The property at approximately at 1174 N Yellowstone Hwy, Parcel RP06N40E174346 will
be rezoned from Community Business Center (CBC) to Medium Density Residential 1
(MDR1) zone.
The property is described as follows on the updated Annexation Map:
Legal Description:
Situated in the State of Idaho, County of Madison, being part of Section 17, Township 6
North, Range 40 East, of BM, being more particularly described as follows:
Commencing at the center'/a corner; Thence north 00'08'11" west, a distance of 828.81
feet along the North - south center of said Section 17 and the existing City of Rexburg
corporation line to the point of beginning; thence south 89°25'00" west, a distance of
899.73 feet along the existing City of Rexburg corporation line to the east right of way of
line of North Yellowstone Highway; Thence north 30°23'50" east, a distance of 257.82
feet along the East right of way of North Yellowstone Highway to a point; Thence south
89°13'24" east, a distance of 747.81 feet to a point; Thence north 00°08'08" west, a
distance of 557.68 feet to a point; Thence south 89°59'38" east, a distance of 21.00 feet to
a point; Thence south 00°08'09" east, a distance of 760.76 feet to the point of beginning,
containing 4.34 acres of land, more or less.
The above annexation description was prepared by Jeffrey M. Rowe, PLS 13856 in April
2022, and is subject to easements and rights -of -way of record.
ORDINANCE NO. 1282 -1-
SECTION I: That the above described property hereby annexed to the City of Rexburg
be, and the same is hereby classified under the Zoning Ordinance of the City of Rexburg
as above set forth; that the Zoning shall be amended to show this annexation and
classification of the above described property so annexed and that said amendment shall
be certified to and declared to be the official Zoning Map of the City of Rexburg by a
certificate of the Mayor and Council of the City of Rexburg endorsed thereon.
SECTION II: This ordinance shall be in full force and effect from and after its passage,
approval and due publication.
PASSED BY THE CITY COUNCIL AND APPROVED BY THE MAYOR this 6" day
of July 2022.
