MUIR Fee: 0.00 Ex-officio Recorder Deputy CITY U F REXBURG Americas Family Community ORDINANCE NO.1281 Rezone Handcart Ln from Mixed Use (MU) to High Density Residential 1 (HDR1) AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG, IDAHO, AND PROVIDING THAT THE ZONED DESIGNATION OF THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED, SITUATED IN REXBURG, MADISON COUNTY, IDAHO, BE CHANGED AS HEREINAFTER DESIGNATED; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY the City of Rexburg, Idaho: SECTION I: That the zoning map of the City of Rexburg, Idaho, which is filed with the city clerk thereof, be, and the same is hereby amended and changed to provide that the hereinafter described property situated in the City of Rexburg, Madison County, State of Idaho, regarding (#22 00193) to rezone approximately Handcard Ln, Parcels RPRPNRV0020010 and RPRPNRV002002A from Mixed Use (MU) to High Density Residential 1 (HDR1) zone in the City of Rexburg, Madison County, Idaho. The legal description of the said properties in Rexburg, Madison County, Idaho, are as follows: Legal Description: Parcel 1: Lot 1, Block 2, Pioneer Village, Madison County, Idaho, as shown on the plat recorded February 28, 2005, as Instrument No. 317999. Parcel 2: A portion of Lot 2, Block 2, Pioneer Village final plat, being a replat of a portion of the plat of Westates Subdivision No. 1, Madison County, Idaho, as shown on the plat recorded February 28, 2005, as Instrument No. 317999, more particularly described as follows: Beginning at a point that is the southeast corner of Lot 1, Block 2 of said Pioneer Village final plat Madison County, Idaho; running thence N. 35°07'58" E. 187.55 feet to the west right of way line of Handcart Lane and also being a point on a curve with a radius of 280.00 feet and a chord that bears S. 31°52'15" E. 160.23 feet; thence running to the right along said curve 162.50 feet thru a central angle of 33°15'07"; thence S. 61000'00" W. 163.20 feet to the east right of way line of Pioneer Road, and also being a point on a curve with a radius of 644.01 feet and a chord that bears N. 38°51'12" W. 79.37 feet; thence running to the left along said curve 79.42 feet thru a central angle of 7°03'57" to the point of beginning. SECTION II: That a new zoning map showing these amendments shall be certified to and declared to be the official zoning map of the City of Rexburg by passage of this Ordinance by the City Council of the City of Rexburg. SECTION III: This ordinance shall become effective upon its passage, approval and publication.
