§ 1.04.020 Zoning Map Revisions
AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be
granted as requested, that it be modified, or that it be denied.”
I. BACKGROUND
The parcel is currently used as an agriculture farm. In March 2007, the property was part of an
annexation and rezone from Agriculture 1 & Agriculture 2 to Low-Density Residential 2 (LDR2).
During the Planning & Zoning meeting on March 1, the motion was made to match the
Comprehensive Plan Map designations allowing the west portion of the lot to be rezoned to LDR2,
but to keep the commercial designation zoned as Transitional Agriculture 1 (TAG1). At the City
Council meeting, March 21, the City Council upheld the Commission’s decision. Steps were made
to change the Comprehensive Plan map designation to Commercial along S 12th W. And, on June
20, 2007, Ord. 989 rezoned the portion along S 12th W to Community Business Center (CBC). In
2012, a Conditional Use Permit for the LDS Church Stake Center at 2332 W 2000 S was approved.
In 2012, a Building Permit application was received and the building was finished in September of
2013. In 2001, the parcel was zoned to Low-Density Residential 2 (LDR2), Medium-Density
Residential 2 (MDR2), and Community Business Center (CBC) (21-00189) previously named
Rexburg Townhomes.

The Rexburg Development Code allows the Commission to make recommendations to the City
Council regarding whether or not the property should or should not be rezoned based on the criteria
found in section §1.04.020.
II. SITE DESCRIPTION
The property is located west of S 12th W to the city-limit border, west of US Highway 20, and north
of W 2000 S. Directly west is the Impact Area. Madison High School is north of this property. East
of this property is John Deere. This property borders the church at 2332 W 200 S on the West,
North, and East. The total area for the lot is 66.8 acres, but only 20 acres are being rezoned.
III. ANALYSIS
If approved the request will result in changing a portion of the parcel from Low-Density Residential 2
(LDR2), Medium-Density Residential 2 (MDR2), and Community Business Center (CBC) to Low-Density
Residential 3 (LDR3).

The request would require the Commission and City Council to review the proposal against one set of
criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200
(Development Code) that are required to be addressed, followed by staff’s analysis of each criterion.
Criteria Rezone Requests (§1.04.020):
a. Be in conformance with the City’s Comprehensive Plan.
The Comprehensive Plan is in conformance with the proposed change.
b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid
waste collection and disposal, and other utilities.
The city has adequate capacities to service this request. Storm drainage will have to be handled on
site.
c. The capacity of existing public services, including but not limited to, public safety services,
public emergency services, schools, and parks and recreational services.
The city has capacity to service this request.
d. The potential for nuisances or health and safety hazards that may adversely affect adjoining
properties.
A Traffic Impact Study will likely have to be completed.
e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision.
The Madison County School District High School/Burton Elementary to the north was rezoned to
Public Facilities (PF) in 2019 (19-00093). Across the highway to the East, Thompson Paving and
Valley Ag have rezoned to Light Industrial (LI) (20-00349 & 20-00770). 1265 Siddoway is
currently in the rezone process with a request to also rezone to Light Industrial (LI) (21-00129).
The land at 2247 S 2000 W was annexed into the city in January 2018 and retained its Community
Business Center (CBC) zoning (17-00623). In 2001, the parcel was zoned to Low-Density
Residential 2 (LDR2), Medium-Density Residential 2 (MDR2), and Community Business Center
(CBC) (21-00189) previously named Rexburg Townhomes.
f. Meets the requirements of the Development Code.
The request meets the requirements of the Development Code.
IV. STAFF RECOMMENDATION
Staff requests that Planning and Zoning consider the rezone a portion of the parcel of land adjacent to the
church at 2332 W 2000 S, from Low-Density Residential 2 (LDR2), Medium-Density Residential 2
(MDR2), and Community Business Center (CBC) to Low-Density Residential 3 (LDR3), if the
Commission finds that the proposed request is compatible with the surrounding area or in the best interest
of the neighborhood and the community.
