March 24, 2022, An application was received for an Annexation & Rezone from Community Business Center (CBC) to Medium-Density Residential 1 (MDR1) at 1174 N Yellowstone Hwy from Ray McDougal. 2. March, 25, 2022, Fees were paid. 3. March 29, 2022, City Council received notification of the request. Staff Reviews were completed and revisions were requested. Legal description did not close to fulfill State requirements. A legal description on a deed was submitted. 4. April 14, 2022, Staff Reviews were completed. Revisions were requested. The legal description on the deed is the same as the description submitted initially. Applicant submitted an amended legal description. Staff Reviews were completed and approved. Notice was sent to the newspaper to be published on April 19th and May 10th, 2022, for the Planning & Zoning hearing. Notice was mailed for P&Z hearing to all property owners within 350’. 5. April 19, 2022, Notice was sent for the City Council hearing to be published on April 29th and May 20th, 2022. 6. May 3, 2022, a Staff Report was attached to the permit, and the applicant was notified. 7. May 11, 2022, Notice was posted on the property. 8. May 16, 2022, Ray McDougal signed the Annexation Agreement for 1174 N Yellowstone Hwy. 9. May 19, 2022, Notice was mailed for City Council hearing to all property owners withing 350’. At time of annexation, the applicant is requesting a change in zoning to MDR1. This is the same parcel requested in Hearing #1. 1114 N Yellowstone Hwy to the south was recently rezoned to MDR1. Similarly zoned parcels are located to the south of the requested parcel. The property is four (4) acres. - Ray McDougal (action) Chairperson Smith recognized this is the same parcel as the previous hearing. It was clarified this recommendation will be to the City Council. Commissioner Discussion: Brad feels this request goes hand-in-hand with the Comprehensive Plan Map change. MOTION: Motion to recommend the City Council approve (22-00182) the Annexation and Rezone from Community Business Center (CBC) to Medium- Density Residential 1 (MDR1) at 1174 N Yellowstone Hwy, because it is contiguous to recent projects that are the same zone, corresponds with other projects in the area, and there does not seem to be conflicts. Action: Approve, Moved by Brad Wolfe, Seconded by Eric Erickson. Commissioner Discussion on the Motion: None VOTE: Motion carried by unanimous roll call vote. (Summary: Yes = 9, No = 0).
