PROPERTY LOCATION: 649 S 2nd W COMPREHENSIVE PLAN: MDR1-HDR2 CURRENT ZONING: High-Density Residential 2 (HDR2) PROPOSED # OF LOTS: 152 Condo Units APPLICABLE CRITERIA: City of Rexburg Development Code (Ordinance No.1200) § 1.04.040 Subdivision Rules AUTHORITY: §10.03.040 (3b) “The Commission may recommend that the amendment be granted as requested, that it be modified, or that it be denied.” I. BACKGROUND In 2009, a Conditional Use Permit (CUP) was granted for 152 dormitory apartments in the Pedestrian Emphasis District (PED with the following conditions (09-00386): 1. Work with adjoining property owner to the North to create a pedestrian pathway on the South boundary of this project 50% of land required for this path & provide 50% of construction cost and an easement for its use. Show on Site Plan. 2. Determine if length of buildings can be approved as part of P&Z meeting. The elevations presented at the meeting tonight are sufficient as Design Review approval. . 3. Trash interior to lot and enclosed. 4. Approved site plan reflecting all conditions and incorporating all City Standards prior to Building Permit. (with berm landscaped. Lighting under 15' in height and not to create glare; adhering to the City's Lighting standards. 6. Bike racks on hard surface must be provided and shown on Site Plan. 7. Sidewalk and pathway maintenance as per PED Ordinance. 8. Parking Contracts to be approved by City Attorney. 9. Apply PED requirements. 10. Shall meet Design Standards. 11. Storm drainage and Engineering considerations approved by City Engineer. This development was originally named “Henderson Apartments” in 2010 when the buildings were built and in 2013, the name had changed to “The Ivy Apartments” when the stairs were remodeled. In 2017, the Ivy obtained a Conditional Use Permit (CUP) for reduced visitor parking to six (6%) percent (17-00756) with no additional conditions. The name of “University View” has been used for the last few years. The Rexburg Development Code allows the Commission to make recommendations to the City Council regarding whether or not the property should or should not be recommended to City Council based on the Development Code requirements §10.03.040. II. SITE DESCRIPTION The property is located at 649 S 2nd W. A group home is located to the west at 660 S 2nd W. Centre Square BYU-I housing is located east of this property at 650 S 1st W. University Village BYU-I housing is located to the south. Nauvoo House is located to the north at 175 W 5th S. There are 152 units. The total area for the lot is 5.11 acres. III. ANALYSIS If approved the request will result in changing a dormitory use to a condominium use. The request would require the Commission and City Council to review the proposal against one set of criteria, for the plat. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development Code) that are required to be addressed, followed by staff’s analysis of each criterion. Criteria Requests • (§10.03.040.C.2) Plat bears all required certificates, acknowledgements and signature blocks. • (§10.03.020.C.3.) Evidence has been submitted showing proof of ownership of the land Case No. 22 00142 Page 3 being platted. • (§10.03.040.C.4) Covenants, Conditions, and Regulations (CC&Rs) • (§10.03.040.C.5) Landscape Plan is not applicable. • (§10.03.040.c.4) Dedications of streets and public improvements. Land has been previously conveyed to the city and recorded. a. Be in conformance with the City’s Comprehensive Plan. 6.1.4 states, “When planning the City, aim to provide housing for Rexburg residents in all stages of life by identifying in the land use plan locations for a variety of dwelling sizes and types including single-family homes, townhomes, mixed-use options, apartments, and condominiums (p.66)." The Comprehensive Plan is in conformance with the proposed change. b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. The city is currently servicing the buildings. c. The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, and parks and recreational services. The city is currently servicing the buildings. d. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. Some units will only have a (1) single parking stall per unit, while others will have two (2) stalls. e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. BYU-I University Apartments added some enclosed stairways and updated some mechanical and electrical systems. Templeview Transitional Care has made some updates to their building. f. Meets the requirements of the Development Code. The request meets the requirements of the Development Code. IV. STAFF RECOMMENDATION Staff requests that Planning and Zoning recommend to City Council to approve the Condominium Plat of University View at 649 S 2nd W, if the Commission finds that the proposed request is compatible with the surrounding area, meets the requirements of the Development Code, and is in the best interest of the neighborhood and the community.
