A Resolution Authorizing a Third-Party Administrator to provide Connection Services to the City of Rexburg Residents from the excess capacity on the Rexburg Municipal Fiber Optic Network.

A RESOLUTION AUTHORIZING AND APPROVING AN AGREEMENT BETWEEN THE CITY OF REXBURG, IDAHO AND A THIRD-PARTY ADMINISTRATOR TO PROVIDE CERTAIN SERVICES TO THE CITY; AUTHORIZING THE MAYOR
OF THE CITY OR OTHER DESIGNATED OFFICERS OF THE CITY TO EXECUTE AND DELIVER THE SAME.
Whereas, the City of Rexburg has designed and built a Municipal Fiber Optic Network to provide services to city facilities and other assets, and
Whereas, this Municipal Fiber Optic Network has been built to accommodate future growth of the City of Rexburg and to support future fiber optic broadband services, and
Whereas, the City of Rexburg has determined that there is excess capacity within the City’s Municipal Fiber Optic Network to allow the City to lease the excess capacity, and
Whereas, the City of Rexburg has determined that there is a need within the city to provide Connection Services to its residents, and
Whereas, the City of Rexburg issued a Request for Proposals to qualified telecommunication firms to manage the Municipal Fiber Optic Network, and
Whereas, the City of Rexburg will contract with a private third-party administrator to fulfill the requirements of connecting the citizens of the City of Rexburg to the Municipal Fiber
Optic Network.
Therefore, the City of Rexburg now desires to cause to be acquired, installed, constructed, and completed an advanced fiber optic communications network to serve residents of the City
through the undertaking of improvements contemplated here by (as more fully described herein, the “Improvements”) and desires further that the third-party administrator shall procure
and install said Improvements, and
Said Improvements will be owned by the City of Rexburg.
Therefore, it is the intention of the City of Rexburg and third-party administrator that the Improvements which provide Connection Services be operated and managed for the mutual benefit
of the City of Rexburg and third-party administrator. The City will receive such fees collected by the third-party administrator, as set forth per the City Master Fee List set by resolution
by the Rexburg
City Council and defined in a Professional Services Contract. The City of Rexburg will pay or cause to be paid Service Fees to the third-party administrator calculated in accordance
with the Professional Services Contract with the amounts paid by the City of Rexburg.
