ADDITIONALINFORMATIONREGARDING
LETTERSOFMAPREVISIONBASEDONFILL
WhenmakingdeterminationsonrequestsforLettersofMapRevisionbasedontheplacementoffill
(LOMR-Fs),theDepartmentofHomelandSecurity’sFederalEmergencyManagementAgency(FEMA)
bases itsdeterminationonthe flood hazardinformationavailableatthe timeofthedetermination.
Requestersshouldbeawarethatfloodconditionsmaychangeornewinformationmaybegeneratedthat
wouldsupersedeFEMA'sdetermination.Insuchcases,thecommunitywillbeinformedbyletter.
Requestersalsoshouldbeawarethatremovalofaproperty(parceloflandorstructure)fromtheSpecial
FloodHazardArea(SFHA)meansFEMAhasdeterminedthepropertyisnotsubjecttoinundationbythe
floodhavinga1-percentchanceofbeingequaledorexceededinanygivenyear(baseflood).Thisdoesnot
meanthepropertyisnotsubjecttootherfloodhazards.Thepropertycouldbeinundatedbyafloodwitha
magnitudegreaterthanthebasefloodorbylocalizedfloodingnotshownontheeffectiveNationalFlood
InsuranceProgram(NFIP)map.
TheeffectofaLOMR-FisitremovestheFederalrequirementforthelendertorequirefloodinsurance
coverageforthepropertydescribed.TheLOMR-Fisnotawaiveroftheconditionthatthepropertyowner
maintainfloodinsurancecoveragefortheproperty.Onlythelendercanwaivethefloodinsurancepurchase
requirementbecause the lenderimposedthe requirement.The property ownermustrequest andreceivea
writtenwaiverfromthelenderbeforecancelingthepolicy.Thelendermaydetermine,onitsownasa
businessdecision,thatitwishestocontinuethefloodinsurancerequirementtoprotectitsfinancialriskon
theloan.
TheLOMR-FprovidesFEMA'scommentonthemandatoryfloodinsurancerequirementsoftheNFIPas
theyapplytoaparticularproperty.ALOMR-Fisnotabuildingpermit,norshoulditbeconstruedassuch.
Anydevelopment,newconstruction,orsubstantialimprovementofapropertyimpactedbyaLOMR-Fmust
complywithallapplicableStateandlocalcriteriaandotherFederalcriteria.
Ifalenderreleasesapropertyownerfromthefloodinsurancerequirement,andthepropertyownerdecides
tocancelthepolicyandseekarefund,theNFIPwillrefundthepremiumpaidforthecurrentpolicyyear,
providedthatnoclaimispendingorhasbeenpaidonthepolicyduringthecurrentpolicyyear.The
propertyownermustprovideawrittenwaiveroftheinsurancerequirementfromthelendertotheproperty
insuranceagentorcompanyservicinghisorherpolicy.Theagentorcompanywillthenprocesstherefund
request.
EventhoughstructuresarenotlocatedinanSFHA,asmentionedabove,theycouldbefloodedbyaflooding
eventwithagreatermagnitudethanthebaseflood.Infact,morethan25percentofallclaimspaidbythe
NFIPareforpoliciesforstructureslocatedoutsidetheSFHAinZonesB,C,X(shaded),orX(unshaded).
Morethanone-fourthofallpoliciespurchasedundertheNFIPprotectstructureslocatedinthesezones.
Therisktostructureslocatedoutside SFHAsisjustnotasgreatastherisktostructureslocatedinSFHAs.
Finally,approximately90percentofallfederallydeclareddisastersarecausedbyflooding,andhomeowners
insurancedoesnotprovidefinancialprotectionfromthisflooding.Therefore,FEMAencouragesthe
widestpossiblecoverageundertheNFIP.
LOMRFENC-1(LOMR-FRemoval)
The revisions madeeffectiveby a LOMR-FaremadepursuanttoSection206oftheFloodDisaster
ProtectionAct of 1973 (P.L.93-234) and areinaccordancewiththeNationalFlood Insurance Act of 1968,
asamended(TitleXIIIof the Housing and UrbanDevelopmentActof1968,P.L.90-448)42 U.S.C.
4001-4128, and 44 CFR Part 65.
Inaccordancewith regulations adopted by thecommunitywhenitmadeapplicationtojointheNFIP,letters
issuedtoreviseanNFIPmapmustbeattachedtothe community's officialrecordcopy of the map.That
mapisavailable for public inspection at the community's officialmaprepository.Therefore,FEMA sends
copies of all such letters to the affected community's official map repository.
ToensurecontinuedeligibilitytoparticipateintheNFIP,thecommunitymustenforceitsfloodplain
managementregulationsusing,ataminimum,the flood elevationsand zone designationsshown on the
NFIPmap, including the revisionsmadeeffective by LOMR-Fs.LOMR-Fsarebased on minimumcriteria
establishedby the NFIP.State,county,andcommunityofficials,basedon knowledge of localconditions
andin the interest of safety,maysethigherstandardsforconstructionin the SFHA. IftheState,county, or
community has adopted morerestrictive and comprehensive floodplain managementcriteria,thesecriteria
take precedence over the minimum Federal criteria.
FEMAdoesnotprintand distribute LOMR-Fstoprimarymapusers,suchaslocalinsuranceagentsand
mortgagelenders;therefore,the community servesasthe repository for LOMR-Fs.FEMAencourages
communitiestodisseminateLOMR-Fsso that interestedpersons,suchas property owners, insurance agents,
andmortgagelenders,maybenefitfromtheinformation.FEMAalsoencouragescommunitiestoprepare
articles for publication inthelocal newspaper thatdescribe the changesmade and theassistance community
officials will provide in serving as a clearinghouse for LOMR-Fs and interpreting NFIP maps.
Whenarestudyisundertaken, or whenasufficientnumber of revisionsoccuronparticularmappanels,
FEMAinitiatesthe printing and distributionprocess for thepanelsandincorporatesthechangesmade
effectivebyLOMR-Fs.FEMAnotifiescommunityofficialsinwritingwhenaffectedmappanelsare
beingphysicallyrevisedanddistributed.IftheresultsofparticularLOMR-Fscannot be reflectedonthe
newmap panels becauseofscalelimitations,FEMAnotifiesthecommunityinwriting and revalidatesthe
LOMR-Fsinthatletter.LOMR-Fsrevalidatedinthiswayusuallywillbecomeeffective1 day afterthe
effective date of the revised map.
