PARCEL SIZE: 4 Acres PROPERTY ID: RP06N40E174346 PROPERTY LOCATION: 1174 N Yellowstone Hwy APPLICABLE CRITERIA: Idaho State Code § 50-222 Annexation by Cities AUTHORITY: § 1.03.080. (D) “The Commission may recommend that the amendment be granted as requested, that it be modified, or that it be denied” I. BACKGROUND The property has a single-family home. There are no records showing activity on this parcel. II. SITE DESCRIPTION The property is located east of N Yellowstone Hwy. There are commercial business parks to the north and west and vacant lots to the east and south. The property is in the City’s Impact Area. The Comprehensive Plan Map designates all the surrounding land as Commercial/Mixed Use, Industrial, and LDR1-MDR1. Community Business Center (CBC) zoned parcels are located to the north, Transitional Agriculture (TAG) to the east, Community Business Center and Medium- Density Residential 1 (MDR1) to the south, and Light Industrial to the west from the requested property. STAFF RECOMMENDATION Staff recommends that the Commission take public testimony and determine if the proposed annexation can be approved, denied or approved with conditions. Staff has reviewed the application and found it meets the requirements for annexation. IV. ANALYSIS for REZONE COMPREHENSIVE PLAN: Commercial/Mixed Use CURRENT ZONING: Community Business Center (CBC) REQUESTED ZONE: Medium-Density Residential 1 (MDR1) Also, at annexation, the applicant is requesting a rezone from CBC to MDR1 for parcel RP06N40E174346. The proposed zoning area is 4 acres. Surrounding Zoning Community Business Center (CBC) to the north, Transitional Agriculture (TAG) to the east, Medium-Density Residential 1 (MDR1) top the south, and Light Industrial (LI) to the west. The request would require the Commission and City Council to review the proposal against one set of criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development Code) that are required to be addressed, followed by staff’s analysis of each criterion. Criteria Rezone Requests (§1.04.020): a. Be in conformance with the City’s Comprehensive Plan. If the Comprehensive Plan Map changes is approved (22-00183), the request will result in changing the Comprehensive Plan Map from the current designation of Commercial/Mixed Use to LDR1-MDR1. The surrounding Comprehensive Plans are Commercial/Mixed Use and MDR1-HDR2. b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. There is capacity for water and sewer. All storm water will have to be handled on site. Access requirements will be per the Idaho Transportation Department. c. The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, and parks and recreational services. N/A d. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. N/A e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. In 2017, a Preliminary Planned Unit Development was approved for Thomson Farms (17- 00704). In June 2019, the Comprehensive Plan Map was changed for this parcel to Low- Moderate (19-00351). In 2020, a Comprehensive Plan Map change was completed to Case No. 22 00182 Page 3 match the approved zoning for Thomson Farms (20-00076). Parcels to the east were zoned to Transitional Agriculture (TAG) in 2020 (20-00914). In 2021, the Comprehensive Plan was amended for this parcel to Commercial/Mixed Use (21-00057). The Teton Vu property to the south was recently changed on the Comprehensive Plan Map to LDR1-MDR1 (22- 00033) and rezoned from CBC to MDR1 (22-00019). f. Meets the requirements of the Development Code. The request meets the requirements of the Development Code. V. STAFF RECOMMENDATION Staff requests that Planning and Zoning recommend to City Council to approve the rezone of the 1174 N Yellowstone Hwy from Community Business Center (CBC) to Medium-Density Residential 1 (MDR1), if the Commission finds that the proposed request is compatible with the surrounding area or in the best interest of the neighborhood and the community.
