PROPERTY LOCATION: Handcart Ln. COMPREHENSIVE PLAN: MDR1-HDR2 (Medium-Density Residential 1 to High-Density Residential 2) CURRENT ZONING: Mixed Use (MU) PROPOSED ZONING: High-Density Residential 1 (HDR1) SURROUNDING LAND USES: (North) – Single-family townhomes (East) – Paul Mitchell School (South) – Commercial (West) – Multi-family APPLICABLE CRITERIA: City of Rexburg Development Code (Ordinance No.1200) § 1.04.020 Zoning Map Revisions AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be granted as requested, that it be modified, or that it be denied.” I. BACKGROUND (00-00058) In 2001, the property was annexed into the city and rezoned Highway Business District, Low-Density Residential 1 (LDR1), and High-Density Residential. This land was part of a Planned Unit Development including eighty (80) acres. A Preliminary and Final Plat were submitted in 2001. In 2004, a Preliminary (04-00436) and Final Plat (05-00014) for Pioneer Village, a commercial strip mall to the south. The Rexburg Development Code allows the Commission to make recommendations to the City Council regarding whether or not the property should or should not be rezoned based on the criteria found in section §1.04.020. SITE DESCRIPTION The property is located south of Mariah Ave. and is bordered one side by Handcart Ln on the east and Pioneer Rd. on the west. The property is part of the Pioneer Village subdivision. There are single-family townhomes to the northwest and multi-family apartments to the northeast and west. A school is located to the east and commercial is to the south. The Comprehensive Plan Map designates all the surrounding land as Commercial/Mixed Use and MDR1-HDR2. High-Density Residential 1 (HDR1) zoned parcels are located to the north, east, and west from the requested property. The property for this application is 1.458 acres. III. ANALYSIS Surrounding Comprehensive Plan Designations If the Comprehensive Plan Map changes is approved (22-00190), the request will result in changing the Comprehensive Plan Map from the current designation of Commercial/Mixed Use to MDR1-HDR2. The surrounding Comprehensive Plans are Commercial/Mixed Use and MDR1-HDR2. Surrounding Zoning Community Business Center (CBC) and High-Density Residential 1 (HDR1) are zoned to the north, west, and east, and Mixed Use (MU) to the south. If approved, the request will result in changing the zoning of two (2) parcels on the west side of Handcart Ln from Mixed Use (MU) to High-Density Residential 1 (HDR1) for 1.458 acres. The request would require the Commission and City Council to review the proposal against one set of criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development Code) that are required to be addressed, followed by staff’s analysis of each criterion. Criteria Rezone Requests (§1.04.020): a. Be in conformance with the City’s Comprehensive Plan. The request would be in conformance with the Comprehensive Plan Map, should the applicant’s request for a Comprehensive Plan Map change from Rural to LDR1-MDR1 (22-000190) be approved. b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. There is capacity for water and sewer facilities. The added traffic for this parcel will not stress existing public streets. Case No. 22 00193 Page 3 c. The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, and parks and recreational services. N/A d. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. N/A e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision. In 2012, the Rockwell Court Apartments were built. From 2012-2016, the Rock Creek Townhomes were under construction. In 2017, Savoye Apartments were built (17-00272) and the nearby Cantamere 4-plexes. In 2019, the Comprehensive Plan Map zone was changed from Commercial to Neighborhood Commercial/Mixed Use for the Pioneer Village Commercial park (19-00752), then rezoned from Community Business Center (CBC) to Mixed Use (MU) (19-00753). f. Meets the requirements of the Development Code. The request meets the requirements of the Development Code. IV. STAFF RECOMMENDATION Staff requests that Planning and Zoning recommend to City Council to approve the rezone of 2 parcels west of Handcart Ln from Mixed Use (MU) to High-Density Residential 1 (HDR1), if the Commission finds that the proposed request is compatible with the surrounding area or in the best interest of the neighborhood and the community.
