PURPOSE: The request is to build an apartment complex and the units
will be sold individually as condominiums.

§ 1.04.040 Subdivision Rules
AUTHORITY: §10.03.040 (3b) “The Commission may recommend that the amendment
be granted as requested, that it be modified, or that it be denied.”
I. BACKGROUND
This development is to the west of Kenneth Square.
Kenneth Square is also a condominium plat, but the
units are sold per building. Kenneth Square was
platted and recorded in 2017.
The Rexburg Development Code allows the
Commission to make recommendations to the City
Council regarding whether or not the property should
or should not be recommended to City Council based
on the Development Code requirements §10.03.040.
II. SITE DESCRIPTION
The property is located east of N Yellowstone Highway. Leishman Electric and American Self-
Storage are located south of this property. Kenneth Square 4-plex condominiums are located to the
east. Paradise Nursery is adjacent to the north. Madison Armory is to the west across N Yellowstone
Hwy. The total area for the lot is 2.682 acres.

III. ANALYSIS
If approved, the request will plat individual units in 12-plexes and one 6-plex for condominium use.
The request would require the Commission and City Council to review the proposal against one set of
criteria, for the plat. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development
Code) that are required to be addressed, followed by staff’s analysis of each criterion.
Criteria Requests
• (§10.03.040.C.2) Plat bears all required certificates, acknowledgements and signature
blocks.
• (§10.03.020.C.3.) Evidence has been submitted showing proof of ownership of the land
being platted.
• (§10.03.040.C.4) Covenants, Conditions, and Regulations (CC&Rs)
• (§10.03.040.C.5) Landscape Plan
• (§10.03.040.c.4) Dedications of streets and public improvements.
a. Be in conformance with the City’s Comprehensive Plan.
The Comprehensive Plan is in conformance with the proposed change.
b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid
waste collection and disposal, and other utilities.
The city has adequate capacities to service this request.
c. The capacity of existing public services, including but not limited to, public safety services,
public emergency services, schools, and parks and recreational services.
The city has capacity to service this request.
d. The potential for nuisances or health and safety hazards that may adversely affect adjoining
properties.

e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision.
In 2017, Kenneth Square condominiums were under construction. Also, a Preliminary Planned Unit
Development was approved for Thomson Farms (17-00704). In 2019, Thomson Farms Phase 1 and
2 started construction for multi-family units. Parcels to the east were zoned to Transitional
Agriculture (TAG) in 2020 (20-00914). (21-00377) A parcel for rezone of the Stonebridge
Townhomes from LDR2 to LDR3 was approved. (21-00514) A Short Plat has been submitted for
the Wight Subdivision on parcel RPR6N40E175400. (21-00589) A new commercial building for an
indoor gun range is under construction for Madison Armory. (22-00086) A Short Plat has been
submitted for CB Shop Subdivision at 940 N 2nd E for commercial properties.

*Parking lots are allowed within the front yard setback, as long as a ten (10’) feet wide landscaped
strip with required buffering is provided.

IV. STAFF RECOMMENDATION
Staff requests that Planning and Zoning recommend to City Council to approve the Condominium Plat of
Yellowstone Heights Condominiums at approximately 238 Ella Lane with the condition the ten (10’) feet
wide landscape strip buffer be provided in the front yard setback, if the Commission finds that the
proposed request is compatible with the surrounding area, meets the requirements of the Development
Code, and is in the best interest of the neighborhood and the community.
