Specifically, this responds to your letter dated March 25, 1996. regarding the effective Flood Insuramce Rate Map (FIRM) for Madison County. Idaho and Incorporated Areas. You requested that the Federal Emergency Management Agency (FEMA) revise the eff:ctive FIRM to show the effects of the V.S. Army Corps of-Eltginms' kmam Creek Channel and Levee Flood Control Project (the Project) on Lyons Creek (also (mown as Lyman Creek). Tlw removal of an SFHA designation from an area does not mean that a property or structure located there could not be flooded. Property in Zone X can be inundated by a flood of a greater magnitude than the base flood. In fact, more than 25. percent of all losses in the NFIP occur to buildings outside the SNIA. Therefore, the voluncary purchase of flood insurance in areas designated 'Lone X may he prudent. The modifications are shown on the enclosed annotated copies of FIRM Panels 16065CO020 D. 0025 D. 0100 D, and 0125 D for Madison County, Who And Incorporated Areas. This LOMR herahy revises these panels of the effective FIRM dated June 3, 1991. The revisions are effective as of the date of this letter; however, a review of the determination made by this LOMR and any requests to alter this determination should be made within 30 days. Any request to alter the determination must be based on scientific or technical data. We will not physically revise and republish the FIRM for your community to reflect the niodificationa made by this LOMR at this time. However, when changes to FIRM Panels 16065CO020 D, 0025 D, 0100 D. and 0125 D for your community warrant a physical revision and republication in the future, we will incorporate the modifications made by this LOMR at that time. This response to your request is based on minimum floodplain management criteria established under the NPIP. Your community is responsible for approving all floodplain development, including chili request, and for ensuring that necessary permits required by Federal or State law have been received. With knowledge of local conditions and in the interest of safety. State and community officials may set higher standards for construction, or may limit development in floodplain areas. If the State of Idaho or your community has adopted more restrictive or comprehensive,floodplain management criteria, these criteria take precedence. The basis of this LOMR is, in whole or in pan, a channel modification project. NFIP regulations, as cited in Paragraph 60.3(b)(7), require that communities assure that the flood -carrying capacity within the altered or relocated portion of any watercourse is maintained. This provision is'incorpormed into your community's existing floodplain management regulations. Consequently, the ultimate responsibilityt<n maintenance of the channel modification rests with your- community. Because this LOMR will not be printed and distributed to -primary users, such as local insurance agents and mortgage lenders, your community will serve as a repository for thew new data. We: encourage you to disseminate the information rdleetW by this LOMR throughout the community, so that interested persons, such as property owners, local insurance agents, and mortgage lenders, may benefit frtmt the information. We also encourage you to prepare an article for publication .in your community's local newspaper. This article should describe the changes that have been made and the assi.Stince that officials of your community will givo'to interested persons by providing .these data and interpreting tttc NFIP maps.. w Tbc map panels as listed above and as revised by this letter will be used for all flood insurance policies and renewals issued for your community. hAR-20-00 MON 11:25 Ain FEMA MITIGATION DIV FAX N0, 4 P. 04 .-. oar, 3 '17liis determination has been made pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (Public Law 93-234) and is in accordance with the National Flood Insurance Act of'1968:.is amended (Title XM of the Housing and Urban Development Act of 1968, Public Law 90.449), 42 U.S.C. 4001- 4128, and 44 CFR Pats 65. Because of the m6difrcations to the FIRM for your community made by this LOMR, certain additional requirements must be met: under Section 1361 of the National Flood Insurance Act of 1968, as atmmded, within 6 months from the dare of this letter. Prior to January 3, 1997, your community is required, as a condition of continued eligibility in the NFIP, to adopt or show evidence of adoption of floodplain management regulations that meet the standards of Section 60.3(c) of the NF[P regulations_ These standards are the minimum requirements and do not supersede any State: or local recluirements.of a more stringent nature. It must be emphasized that all of the standards specified is Section 60.3(c) of the NFIP regulations must he enacted in a legally enforceable document. This includes adoption of the effective FI1W to wlmicli regulations apply and the modifications made by this LOMR. Some of the standards should already have been enacted by your community. Any additional requirements can be met by taking one of the following actions: 1. Amending existing regulations to incorporate any additional requirements of Section 60.3(c); 2. Adopting all of the standards of Section 60.3(c) into one new, comprehensive set of regulations; or Showing evidence that regulations have previously been adopted that. meet or exceed the minimum, requirements of Section 60.3(c). Communities that fail to enact: the necessary floodplain management regulations will be suspended from participation in the NFIP and subject to the prohibitions contained -in Section 202(a) of the Act as amendod. A Consultation Coordination Officer (CCO) has been designated to assist your community with any difficulties you maybe encountering is enacting the floodplak managenmi t regulations.
