PURPOSE: The request is to change subdivide an existing apartment
complex into individual units sold individually as
condominiums.

§ 1.04.040 Subdivision Rules
AUTHORITY: §10.03.040 (3b) “The Commission may recommend that the amendment
be granted as requested, that it be modified, or that it be denied.”
I. BACKGROUND
This development was previously named “Sugar Mill”. In
2016, a Comprehensive Plan Map change from Neighborhood
Commercial/Mixed Use to Moderate-High Density Residential
for 263 & 267 W 4th S & 429 S 3rd W (16-00415) was
approved. Then, the properties were rezoned from Community
Business Center (CBC) to High-Density Residential 1 (HDR1)
(16-00485). A Conditional Use Permit was issued in 2016 for
reduced parking of 62% in the Pedestrian Emphasis District
(PED) for dormitory (16-00706). Building Permits were issued
(16-00683) & (16-00684) and the buildings were completed in
2017.
The Rexburg Development Code allows the Commission to make recommendations to the City
Council regarding whether or not the property should or should not be recommended to City Council
based on the Development Code requirements §10.03.040.

II. SITE DESCRIPTION
The property is located at 431 S 3rd W. A church is located to the north at 345 S 3rd W. East of this
property is the Rexburg Housing office. Tuscany Place Apartments are located to the south.
Brenchley Apartments are located to the west. The total area for the lot is 1.25 acres.
III. ANALYSIS
If approved the request will result in changing a dormitory use to a condominium use.
The request would require the Commission and City Council to review the proposal against one set of
criteria, for the plat. Below, staff has provided all the criteria listed by Ordinance No. 1200 (Development
Code) that are required to be addressed, followed by staff’s analysis of each criterion.
Criteria Requests
• (§10.03.040.C.2) Plat bears all required certificates, acknowledgements and signature
blocks.
• (§10.03.020.C.3.) Evidence has been submitted showing proof of ownership of the land
being platted.
• (§10.03.040.C.4) Covenants, Conditions, and Regulations (CC&Rs)
• (§10.03.040.C.5) Landscape Plan is not applicable.
• (§10.03.040.c.4) Dedications of streets and public improvements.
Land has been previously conveyed to the city and recorded.
a. Be in conformance with the City’s Comprehensive Plan.
The Comprehensive Plan is in conformance with the proposed change.
b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid
waste collection and disposal, and other utilities.
The city has adequate capacities to service this request.
c. The capacity of existing public services, including but not limited to, public safety services,
public emergency services, schools, and parks and recreational services.
The city has capacity to service this request.
d. The potential for nuisances or health and safety hazards that may adversely affect adjoining
properties.

e. Recent changes in land use on adjoining properties or in the neighborhood of the map revision.
In 2018, the Roost requested a Conditional Use Permit for reduced parking in the PED for
dormitory (18-00006). In 2020, the Comprehensive Plan Map was changed for this area (20-
00660). A rezone is in process for 358 S 3rd W (21-01033) from Community Business Center
(CBC) to High-Density Residential 1 (HDR1).

IV. STAFF RECOMMENDATION
Staff requests that Planning and Zoning recommend to City Council to approve the Condominium Plat of
Brigham’s Mill at 431 S 3rd W, if the Commission finds that the proposed request is compatible with the
surrounding area, meets the requirements of the Development Code, and is in the best interest of the
neighborhood and the community.
