AUTHORITY: §1.04.020 (D) “The Commission may recommend that the amendment be
granted as requested, that it be modified, or that it be denied.”
I. BACKGROUND
The property is currently farm ground. In 2002, this land was included in the Impact Area of the City of
Rexburg (02-00247). In 2003, this property was annexed into the City of Rexburg as Area 4 and zoned
as Low-Density Residential (03-00098).
The Rexburg Development Code allows the Commission to make
recommendations to the City Council regarding whether or not
the property should or should not be rezoned based on the criteria
found in section §1.04.020.
II. SITE DESCRIPTION
The property is located south of Hidden Valley Subdivision,
adjacent at the north of these properties to PH7 & PH8. There
are a couple of parcels between these and S Millhollow Rd and the
Mill Hollow Subdivision. The property is 95 acres.

III. ANALYSIS
Surrounding Comprehensive Plan Designations
The Comprehensive Plan designation to the north, south and west of
this property is LDR1-MDR1 and Rural to the east.
Surrounding Zoning
Low-Density Residential 1 (LDR1) & Low-Density Residential 2
(LDR2) are zoned to the north and south, Transitional Agriculture
(TAG) to the east, and LDR1 to the west. Harvest Heights Subdivision
southwest of these parcels is Rural Residential 2 (RR2).
If approved, the request will result in changing the zoning of parcels
RPRXBCA0291838, RPRXBCA0291851, and RPRXBCA0297510
from Low-Density Residential 1 (LDR1) to Low-Density Residential 2
(LDR1) for 95 acres.
The request would require the Commission and City Council to review the proposal against one set of criteria,
for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1200
(Development Code) that are required to be addressed, followed by staff’s analysis of each criterion.
Criteria Rezone Requests (§1.04.020):
a. Be in conformance with the City’s Comprehensive Plan.
The request is in conformance with the Comprehensive Plan Map.
b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities,
solid waste collection and disposal, and other utilities.
Utilities will need to be extended to service these parcels. There is capacity for water and sewer
facilities. The added traffic for this parcel will not stress existing public streets.
c. T he capacity of existing public services, including but not limited to, public safety
services, public emergency services, schools, and parks and recreational services. N/A
d. The potential for nuisances or health and safety hazards that may adversely affect
adjoining properties. N/A
e. Recent changes in land use on adjoining properties or in the neighborhood of the map
revision.
In 2003, a plat for PH6 (03-00118) and PH7 (03-00119) of Hidden Valley were approved. In 2005,
Hidden Valley PH8 (05-00088) was approved. Many building cases for single-family homes were
submitted starting in 2004 and continued until 2012. In 2004, a plat was submitted for the Mill
Hollow DIV2 subdivision (04-000755 & 04-00078) along S Mill Hollow Rd. In 2019, the
Comprehensive Plan designation was updated when the designations were simplified (19-00351).
f. Meets the requirements of the Development Code.

IV. STAFF RECOMMENDATION
Staff requests that Planning and Zoning recommend to City Council to approve the rezone of
RPRXBCA0291838, RPRXBCA0291851, and RPRXBCA0297510 from Low-Density Residential 1 (LDR1)
to Low-Density Residential 2 (LDR1), if the Commission finds that the proposed request is compatible with
the surrounding area or in the best interest of the neighborhood and the community.
