ORDINANCE NO. 1276
AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF REXBURG, IDAHO; DESCRIBING SAID LANDS AND DECLARING SAME A PART OF THE CITY OF REXBURG, IDAHO; AND AMENDING AND CHANGING THE ZONING
MAP OF THE CITY OF REXBURG, IDAHO, AND THE CLASSIFICATION OF THE SAME UNDER THE ZONING ORDINANCE OF THE CITY OF REXBURG, IDAHO; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
WHEREAS, the lands hereinafter described are contiguous and adjacent to the City of Rexburg, Idaho, and have been laid off, subdivided or platted, and/or the City has been requested
to annex the same to the City of Rexburg, Idaho; and
WHEREAS, it appears to the Mayor and City Council of the City of Rexburg, Idaho, that the hereinafter described properties is subject to annexation to the City of Rexburg under and
pursuant to the provisions of Section 50-222 - Category A, Idaho Code, and that said lands should be annexed to and become a part of the City of Rexburg, Idaho; and
WHEREAS, the City Council referred the zoning of the affected territory for report and recommendations to the Planning and Zoning Commission, and the Planning and Zoning Commission
made its report and recommendations for zoning classification of the hereinafter described properties proposed to be annexed; and
WHEREAS, the Council has determined that the proper classification under the Zoning Ordinance of the City of Rexburg, Idaho, for the properties to be annexed is as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, AS FOLLOWS:
The properties located at approximately 1022 and 1040 W Main St, Parcels MHMH03410, RP06N39E244821, RP06N39E246001, RP06N39E244825, and RP06N39E244803 in the Community Business Center
(CBC) and Transitional Agriculture (TAG) zones in the Impact Area for the City of Rexburg. These properties are hereby annexed to the City of Rexburg and are hereby declared to be a
part of the City of Rexburg, Idaho (#21 00973).
The properties at approximately 1022 and 1040 W Main St, Parcels MHMH03410, RP06N39E244821, RP06N39E244825, and RP06N39E244803 will be rezoned from Community Business Center (CBC) to
Mixed Use (MU) zone.
The properties are described as follows on the updated Annexation Map:
Legal Description:
Annexation only D.S.H. Property Parcel RP06N39E246001:
Commencing at the southwest corner of Section 24, Township 6 North, Range 39 East, Boise Meridian, Madison County, Idaho, and running thence north 0°09’30” west, a distance of 846.70
feet along the west section line; thence North 90°00’00” east a distance of 48.00 feet; thence North 0°09’30” west a distance of 768.80 feet to the true point of beginning; thence north
0°09’30” west, a distance of 767.10 feet; thence north 90°00’00” east, a distance of 965.08 feet; thence south 0°00’00” east, a distance of 767.10 feet; thence south 90°00’00” west,
a distance of 962.96 feet to the point of beginning. Subject to existing county road right of way and easements of record.
Annexation and Rezone to Mixed Use Zone Erickson 40 & ITD Right-of Way Property:
Erickson 40:
All that portion of the SW 1/4 of Section 24, Township 6 North, Range 39 East, Boise Meridian, Madison County, Idaho, lying West of US Highway Nos. 191 and 20.
Less and Excepting:
The West 61 rods of the SW 1/4 of Section 24, Township 6 North, Range 39 East, Boise Meridian, Madison County, Idaho.
ITD Right-of Way:
Beginning at a point on the South line of Section 24, Township 6 North, Range 39 East, Boise Meridian, coincident with Station 13+00 of state Highway No. 88 Survey as shown on the plans
of said U.S. Highway No’s. 191 and 20 Project No. F-6471(81) Highway Survey and which point is approximately 1300 feet, East from the Southwest corner of said Section 24;
Thence North 0°09’54” West 40.0 feet to a point in the Northerly right of way line of existing State Highway No. 80;
Thence North 89°50’06” East along said existing Northerly right of way line 233.06 feet to a point that bears South 89°51’24” West 266.19 feet from Station 1483+94.48 of said U.S. Highway
No’s. 191 and 20 Highway Survey;
Thence North 5°51’05” East 1399.78 feet to a point in a line parallel with and 120.0 feet Westerly from the centerline and bears South 89°51’24” West from Station 1597+86.69 of said
U.S. Highway No’s. 191 and 20 Highway Survey;
Thence North 0°08’36” West along said parallel line 1208.0 feet, more of less, to a point in the North line of the NE1/4 SW1/4 of said Section 24 and opposite Station 1519+94.66 of said
U.S. Highway No’s. 191 and 20 Highway Survey;
Thence Easterly along said North line 240.0 feet, more or less, to a point in a line parallel with and 120.0 feet Easterly from the centerline and bears North 89°51’24” East 120.0 feet
from Station 1519+95.66 of said U.S. Highway No’s. 191 and 20 Highway Survey;
Thence South 0°06’36” East along said last parallel line 1394.0 feet, more or less, to a point opposite Station 1596+99.72 of said U.S. Highway No’s. 191 and 20 Highway Survey;
Thence South 6°34’05” East 1304.15 feet to a point that bears North 89°51’24” East 266.38 feet from Station 1493+95.44 of said U.S Highway No’s. 191 and 20 highway Survey;
Thence South 0°09’54” East 40.0 feet to a point in the South line of said Section 24;
Thence South 89°59’06” West along said South line 770.0 feet, more or less, to the Point of Beginning.
SECTION I: That the above described property hereby annexed to the City of Rexburg be, and the same is hereby classified under the Zoning Ordinance of the City of Rexburg as above set
forth; that the Zoning shall be amended to show this annexation and classification of the above described property so annexed and that said amendment shall be certified to and declared
to be the official Zoning Map of the City of Rexburg by a certificate of the Mayor and Council of the City of Rexburg endorsed thereon.
SECTION II: This ordinance shall be in full force and effect from and after its passage, approval and due publication.
