Goe PURPOSE: The request is to change the City’s Comprehensive Plan for this parcel. PROPERTY LOCATION: 1114 N Yellowstone COMPREHENSIVE PLAN: Commercial/Mixed Use PROPOSED COMPREHENSIVE PLAN DESIGNATION: LDR1 – MDR1 (Low-Density Residential 1 to Medium-Density Residential 1) CURRENT ZONING: Community Business Center (CBC) SURROUNDING COMPREHENSIVE PLAN DESIGNATIONS: (North) – Commercial/Mixed Use (East) – LDR1-MDR1 (West) - Industrial (South) - Commercial/Mixed Use & LDR1-MDR1 SURROUNDING LAND USES: (North) – Single-family home (East) – Vacant Land (South) – Multi-family homes (West) – Rexburg Business Park subdivision APPLICABLE CRITERIA: City of Rexburg Development Code (Ordinance No.1200) § 1.04.020 Comprehensive Plan Amendment AUTHORITY: § 1.03.080 (D) “The Commission may recommend that the amendment be granted as requested, that it be modified, or that it be denied.” I. BACKGROUND The property is the location of the Teton Vu Drive-In. In 2006, Thomas Goe rezoned the property from Low-Density Residential 3 (LDR3) to Community Business Center (06-00047). The Rexburg Development Code allows for the Commission to make recommendations to the City Council regarding whether or not the property should or should not be changed on the Comprehensive Plan Map based on the criteria found in section §1.04.020. SITE DESCRIPTION The property is located east of N Yellowstone Hwy. There is a single-family home to the north, a vacant lot to the east, a commercial business to the west, and multi-family homes to the south. Medium-Density Residential 1 (MDR1) zoned parcels are located to the south from the requested property at the Thomson Farms subdivision. The property is 10.84 acres. III. ANALYSIS If approved the request will result in changing the Comprehensive Plan Map from the current designation of Commercial/Mixed Use to Low-Density Residential 1 to Medium-Density Residential 1 (LDR1- MDR1). The request would require the Commission and City Council to review the proposal and approve or deny this application. Public Works reviewed the application and noted the following items: • A Traffic Impact Study will likely be required. • Idaho Transportation Department (ITD) requirements will need to be met. • Sewer is nearing capacity in this area. The City is working on projects to increase the capacity. IV. STAFF RECOMMENDATION Staff recommends that this Comprehensive Plan Map change be considered. The Planning and Zoning Commission should take testimony in public hearing to determine if the request is in the best interest of the neighborhood and the community.
